HOUSE RESOLUTION

 

 

Requesting the director of transportation to adopt rules pursuant to chapter 91, hawaii revised statutes, to require vehicle inspections to assess the level of noise emitted by the vehicle's exhaust.

 

 

 

        WHEREAS, exposure to prolonged or high-volume noise has been shown to cause a range of health problems, including hearing loss, stress, hypertension, high blood pressure, high cholesterol, speech interference, and sleep disruption; and

 

        WHEREAS, motor vehicles are a major source of noise in the community; and

 

        WHEREAS, existing state law prohibits the sale, alteration, and any installation of a muffler that noticeably increases the noise emitted by a motor vehicle above that emitted by the vehicle as equipped from the factory; and

 

        WHEREAS, however, the existing law is difficult to enforce because it requires a comparison to the vehicle as distributed from the factory; and

 

        WHEREAS, noise restrictions will be easier to enforce if the specific noise level is specified and may be assessed in a formal process, such as through motor vehicle safety inspections; now, therefore,

 

        BE IT RESOLVED by the House of Representatives of the Thirty-first Legislature of the State of Hawaii, Regular Session of 2021, that the Director of Transportation is requested to adopt rules pursuant to chapter  91, Hawaii Revised Statutes, to require vehicle inspections to assess the level of noise emitted by the vehicle's exhaust; and

        BE IT FURTHER RESOLVED that it is requested that the standard for maximum allowed noise level be set at 94 decibels for all motor vehicles; and

 

        BE IT FURTHER RESOLVED that a certified copy of this Resolution be transmitted to the Director of Transportation.
