SENATE CONCURRENT

RESOLUTION

 

 

AUTHORIZING THE SALE OF A LEASE OF CERTAIN SUBMERGED LANDS AT KANEOHE BAY, KANEOHE, OAHU, FOR NON-COMMERCIAL BOAT PIER PURPOSES, BY PUBLIC AUCTION.

 

 

        WHEREAS, the Board of Land and Natural Resources, at its regularly scheduled July 26, 2019 meeting, as agenda item D-6, approved a set-aside and management right-of-entry for approximately 6.5 acres of submerged lands seaward of Tax Map Key:  (1)4-4-022:032, to the Department of Land and Natural Resources, Division of Boating and Ocean Recreation; and

 

        WHEREAS, the Board of Land and Natural Resources, at its regularly scheduled January 8, 2021 meeting, as agenda item J-2, authorized the sale of a lease of submerged lands at public auction, encompassing approximately 3.3648 acres, or 146,570 square feet, of submerged lands seaward of Tax Map Key:  (1)4-4-022:032, Kaneohe Bay, Kaneohe, Oahu, for non-commercial boat pier purposes, subject to the terms, covenants, and conditions set forth in the lease; and

 

        WHEREAS, the term of the abovementioned lease will be for fifty-five years; and

 

        WHEREAS, under the terms of the abovementioned lease, the lessee shall be prohibited from authorizing tenants to live aboard their vessels or otherwise use their vessels as a place of principal habitation; and

 

        WHEREAS, section 171-53(c), Hawaii Revised Statutes, requires prior approval of the Governor and prior authorization of the Legislature by concurrent resolution to lease state submerged lands; now, therefore,

 

        BE IT RESOLVED by the Senate of the Thirty-first Legislature of the State of Hawaii, Regular Session of 2021, the House of Representatives concurring, that the Board of Land and Natural Resources is hereby authorized to lease a portion of state submerged lands seaward of the property identified as Tax Map Key:  (1)4-4-022:032, Kaneohe Bay, Kaneohe, Oahu for non-commercial boat pier purposes pursuant to section 171-53(c), Hawaii Revised Statutes; and

 

        BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Governor and the Chairperson of the Board of Land and Natural Resources.
