1 A bill to be entitled
2 An act relating to local occupational licensing;
3 amending s. 489.117, F.S.; prohibiting local
4 governments from requiring a license issued by the
5 local government or the state for certain job scopes;
6 prohibiting local governments from requiring a license
7 issued by the local government or the state to obtain
8 a building permit for such job scopes; authorizing
9 local governments to impose local licensing
10 requirements for certain specialty jobs scopes;
11 providing an effective date.

13 Be It Enacted by the Legislature of the State of Florida:
14
15 Section 1. Paragraph (a) of subsection (4) of section
16 489.117, Florida Statutes, is amended to read:
17 489.117 Registration; specialty contractors.—
18 (4)(a) A person whose job scope does not substantially
19 correspond to either the job scope of one of the contractor
20 categories defined in s. 489.105(3)(a)-(o), or the job scope of
21 one of the certified specialty contractor categories established
22 by board rule, is not required to register with the board. A
23 local government, as defined in s. 163.211:,

26 not substantially correspond to the job scope of one of the
27 contractor categories defined in s. 489.105(3)(a)-(o) and (q) or
28 authorized in s. 489.1455(1). For purposes of this section, job
29 scopes for which a local government may not require a license
30 issued by the local government or by the state include, but are
31 not limited to, painting; flooring; cabinetry; interior
32 remodeling without a structural component; driveway or tennis
33 court installation; handyman services; decorative stone, tile,
34 marble, granite, or terrazzo installation; plastering; pressure
35 washing; stuccoing; caulking; and canvas awning and ornamental
36 iron installation. All work performed within these job scopes
37 without a license issued by the local government or by the state
38 must comply with all applicable local ordinances regarding such
39 work; however, a local government may not require a license
40 issued by the local government or by the state to obtain a
41 building permit for these job scopes.
42 2. May require a person to obtain a license issued by the
43 local government for all of the following specialty job scopes,
44 or any part or combination thereof, if the local government
45 imposed such a licensing requirement before January 1, 2021:
46 a. Aluminum or screen enclosure, with or without concrete.
47 b. Carpentry, with a structural component, or finish
48 carpentry, without a structural component.
49 c. Pool safety barrier.
50 d. Concrete forming, placing, or finishing, including on

51 or off grade.
52 e. Demolition.
53 f. Dredging and land filling.
54 g. Excavation and clearing.
55 h. Fence installation and erection.
56 i. Garage door installation.
57 j. Gasoline tank and pump.
58 k. Hurricane or windstorm protection.
59 l. Irrigation sprinklers.
60 m. Landscaping (application of fertilizers).
61 n. Marine work.
62 o. Masonry, with a structural component.
63 p. Paving, sealing, or striping.
64 q. Pile driving.
65 r. Plaster and lath.
66 s. Prestressed precast concrete.
67 t. Reinforcing iron and steel.
68 u. Rental apartment maintenance and repair.
69 v. Roof painting, coating, and cleaning.
70 w. Sandblasting or waterproofing.
71 x. Solar heating installation.
72 y. Specialty structure work performed by a specialty
73 contractor, as defined in s. 489.105(3)(q), or by a specialty
74 structure contractor as defined in the administrative rules of
75 the department, including gutters, metal substructures, pool

76 enclosures, pre-formed panel-post and beam roofs, roof-overs,
77 screened enclosures, screened porches, sunrooms, and windstorm
78 protective devices.
79 z. Structural iron, metals, and steel erection.
80 aa. Swimming pool enclosures.
81 bb. Swimming pool or spa, including commercial or
82 residential repair or service.
83 cc. Tennis court.
84 dd. Tree removal and trimming.
85 ee. Veneer, including aluminum or vinyl gutters, siding,
86 soffit, or fascia.
87 ff. Window and door installation.
88 Section 2. This act shall take effect upon becoming a law.
