1 A bill to be entitled
2 An act relating to political advertisements for
3 nonpartisan office; amending s. 106.143, F.S.;
4 providing that a political advertisement paid for by a
5 candidate for nonpartisan office may include a certain
6 statement; deleting provisions that prohibit political
7 advertisements for candidates running for nonpartisan
8 office from disclosing the candidates' political party
9 affiliation and that prohibit such candidates from
10 campaigning based on party affiliation; providing an
11 effective date.

13 Be It Enacted by the Legislature of the State of Florida:

15 Section 1. Subsections (1) and (3) of section 106.143,
16 Florida Statutes, are amended to read:
17 106.143 Political advertisements circulated prior to
18 election; requirements.—
19 (1)(a) Any political advertisement that is paid for by a
20 candidate running for partisan office, except a write-in
21 candidate, and that is published, displayed, or circulated
22 before, or on the day of, any election must prominently state:
23 1. "Political advertisement paid for and approved by
24 ...(name of candidate)..., ...(party affiliation)..., for
25 ...(office sought)..."; or

26 2. "Paid by ...(name of candidate)..., ...(party
27 affiliation)..., for ...(office sought)...."
28 (b) Any political advertisement that is paid for by a
29 candidate running for nonpartisan office, except a write -in
30 candidate, and that is published, displayed, or circulated
31 before, or on the day of, any election must include the
32 statement required under paragraph (a), but may state
33 "nonpartisan" in lieu of party affiliation.
34 (c)(b) Any political advertisement that is paid for by a
35 write-in candidate and that is published, displayed, or
36 circulated before, or on the day of, any election must
37 prominently state:
38 1. "Political advertisement paid for and approved by
39 ...(name of candidate)..., write-in candidate, for ...(office
40 sought)..."; or
41 2. "Paid by ...(name of candidate)..., write-in candidate,
42 for ...(office sought)...."
43 (d)(c) Any other political advertisement published,
44 displayed, or circulated before, or on the day of, any election
45 must prominently:
46 1. Be marked "paid political advertisement" or with the
47 abbreviation "pd. pol. adv."
48 2. State the name and address of the persons paying for
49 the advertisement.
50 3. State whether the advertisement and the cost of

51 production is paid for or provided in kind by or at the expense
52 of the entity publishing, displaying, broadcasting, or
53 circulating the political advertisement.
54 (e)(d) Any political advertisement made pursuant to s.
55 106.021(3)(d) must prominently state the name and address of the
56 political committee or political party paying for the
57 advertisement.
58 (3) Any political advertisement of a candidate running for
59 partisan office shall express the name of the political party of
60 which the candidate is seeking nomination or is the nominee. If
61 the candidate for partisan office is running as a candidate with
62 no party affiliation, any political advertisement of the
63 candidate must state that the candidate has no party
64 affiliation. A political advertisement of a candidate running
65 for nonpartisan office may not state the candidate's political
66 party affiliation. This section does not prohibit a political
67 advertisement from stating the candidate's partisan-related
68 experience. A candidate for nonpartisan office is prohibited
69 from campaigning based on party affiliation.
70 Section 2. This act shall take effect July 1, 2023.
