1 A bill to be entitled
2 An act relating to use and access of public restrooms;
3 amending s. 381.009, F.S.; revising prohibited acts in
4 public bathroom facilities; amending s. 509.221, F.S.;
5 prohibiting a public food service establishment and
6 certain businesses barring certain individuals from
7 using public bathroom facilities; prohibiting a public
8 food service establishment and certain businesses from
9 posting certain signs to prevent certain individuals
10 from accessing a public bathroom; providing an
11 effective date.

13 Be It Enacted by the Legislature of the State of Florida:

15 Section 1. Section 381.009, Florida Statutes, is amended
16 to read:
17 381.009 Public bathroom facilities Toilets required by
18 department regulations; charge for use of prohibited acts.—
19 (a) No place of employment or place serving or selling
20 products or services to the public shall:
21 (1) Make a charge for the use of any public bathroom
22 facilities toilet which is required to be provided by regulation
23 of the Department of Health.
24 (2) Prohibit guest access to public bathroom facilities.
25 (3) Post an "out of service" sign at public bathroom

26 facilities to prevent guest access.
27 (b) Any place of employment or place serving or selling
28 products or services to the public which violates this act is
29 guilty of a misdemeanor of the second degree, punishable as
30 provided in s. 775.083.
31 Section 2. Paragraphs (c) and (d) are added to subsection
32 (1) of section 509.221, Florida Statutes, to read:
33 509.221 Sanitary regulations.—
34 (1)
35 (c) A public food service establishment may not prohibit
36 guest access to public bathroom facilities.
37 (d) A public food service establishment may not post an
38 "out of service" sign at public bathroom facilities to prevent
39 guest access.
40 Section 3. This act shall take effect July 1, 2023.
