5 wireless provider to provide automatic location
6 identification of an account holder's wireless
7 telephone in certain circumstances; requiring
8 automatic location identification services to be
9 provided through an emergency number created by the
10 wireless provider; requiring calls to such number be
11 answered immediately; prohibiting callers of such
12 number from being placed on hold; specifying the
13 format of receipt of automatic location identification
14 information; authorizing certain persons to contact a
15 wireless provider and request a block for a specified
16 timeframe on an account holder's ability to access
17 automatic location identification services or
18 information; requiring such requests to be
19 confidential; authorizing a wireless provider of
20 automatic location identification services to charge a
21 specified fee; providing an effective date.

27 365.1755 Emergency telephone number; automatic location
28 identification; wireless providers.—
29 (1) As used in this section:
30 (a) "Account holder" means a person who is legally
31 responsible and who enters into an agreement with a wireless
32 telephone service provider for the purchase of a wireless
33 telephone.
34 (b) "Automatic location identification" means the
35 automatic display at the Public Safety Answering Point of the
36 caller's mobile telephone number, the address or location of the
37 wireless telephone, and supplementary emergency services
38 information.
39 (c) "Emergency" means a situation, physical condition, or
40 method of operation which presents imminent danger of death or
41 serious physical or mental harm to a person.
42 (d) "Family or household member" means spouses; former
43 spouses; persons related by blood or marriage; persons who are
44 presently residing together as if a family or who have resided
45 together in the past as if a family; and persons who are parents
46 of a child in common regardless of whether they have been
47 married. Except for persons who have a child in commo n, the
48 family or household members must be currently residing or have
49 in the past resided together in the same single dwelling unit.
50 (e) "Mobile telephone number" means the telephone number

51 assigned to a wireless telephone at the time of initial
52 activation.
53 (f) "Wireless services provider" means a person who
54 provides services using licensed or unlicensed spectrum, whether
55 at a fixed location or mobile, using wireless facilities.
56 (2) In the event of an actual or perceived emergency, a
57 wireless provider shall, immediately upon the request of an
58 account holder, provide automatic location identification of any
59 of the account holder's wireless telephones on their account.
60 (3) Automatic location identification services shall be
61 provided through a unique and well-advertised emergency number
62 created by the wireless services provider. There shall be no
63 wait times for persons who call the emergency number and the
64 account holder shall not be placed on hold at any time.
65 (4) Any automatic location identification information
66 provided by the wireless provider shall be verbally provided and
67 graphically transmitted to the account holder's wireless
68 telephone he or she is calling from, regardless of whether the
69 automatic location identification service has been activat ed or
70 deactivated on the wireless telephone, except as provided in
71 section (5).
72 (5) A family or household member of an account holder who
73 uses the account holder's wireless telephone may contact the
74 wireless provider and request a temporary block, not to exceed
75 30 days, on the account holder's ability to be provided with

76 automatic location identification services or information. The
77 request shall be confidential and may not be provided to the
78 account holder.
79 (6) A wireless provider may charge a fee for automatic
80 location identification services at no more than $5 per request.
81 Section 2. This act shall take effect July 1, 2023.
