1 A bill to be entitled
2 An act relating to a review under the Open Government
3 Sunset Review Act; amending s. 98.075, F.S., which
4 provides an exemption from public records requirements
5 for certain information received by the Department of
6 State from another state or the District of Columbia
7 which is confidential or exempt pursuant to the laws
8 of that jurisdiction; removing the scheduled repeal of
9 the exemption; providing an effective date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. Paragraph (c) of subsection (2) of section
14 98.075, Florida Statutes, is amended to read:
15 98.075 Registration records maintenance activities;
16 ineligibility determinations.—
17 (2) DUPLICATE REGISTRATION.—
18 (c) Information received by the department from another
19 state or the District of Columbia upon the department becoming a
20 member of a nongovernmental entity as provided in subparagraph
21 (b)1., which is confidential or exempt pursuant to the laws of
22 that state or the District of Columbia, is exempt from s.
23 119.07(1) and s. 24(a), Art. I of the State Constitution. The
24 department shall provide such information to the supervisors to
25 conduct registration list maintenance activities. This paragraph

26 is subject to the Open Government Sunset Review Act in
27 accordance with s. 119.15 and shall stand repealed on October 2,
28 2023, unless reviewed and saved from repeal through reenactment
29 by the Legislature.
30 Section 2. This act shall take effect October 1, 2023.
