II.Summary of Amendments Contained in Message:
House Amendment – Barcode 968849 removes the amendment to s. 943.0583(3)(b), F.S., that
expands the basis on which a victim of human trafficking may seek to expunge an offense that is
listed in s. 775.084(1)(b)1. in certain circumstances (which has been amended to CS/CS/SB
772). Language on the Open Government Sunset Review Act is relocated within the section, and
the provision is amended to include the expansion of public records exemptions in subsections
(10) and (11). The amendment clarifies that the public necessity statement applies to human
trafficking victims who have been arrested for offenses committed, or reported to have been
committed, as a result of being trafficked rather than to those victims who have been arrested,
charged, or convicted of crimes committed at the behest of their traffickers. Finally, the effective
date of the bill is modified from July 1, 2022 to take effect on the same date that SB 772 or
similar legislation takes effect, if such legislation is adopted in the same legislative session or an
extension thereof and become a law.
