1 A bill to be entitled
2 An act relating to the City of Freeport, Walton
3 County; providing exceptions to general law; providing
4 requirements for a specialty center designation;
5 authorizing the sale of alcoholic beverages for
6 consumption on the premises of a specialty center under
7 certain conditions; providing that an applicant for an
8 alcoholic beverage license to be located in a
9 specialty center may not be denied licensure under
10 certain conditions; providing an effective date.

12 Be It Enacted by the Legislature of the State of Florida:

14 Section 1. Notwithstanding s. 561.20(2), Florida Statutes,
15 or any other provision of law, the Division of Alcoholic Beverages
16 and Tobacco of the Department of Business and Professional
17 Regulation may designate property as a specialty center within
18 the city of Freeport if a minimum of 25 acres adjacent to the
19 specialty center was donated to the Walton County School Board
20 and at the time of the donation the specialty center property and
21 the donated property were owned by the same entity or an entity
22 with common ownership. Such specialty center may not comprise more
23 than 15 acres.
24 Section 2. Notwithstanding ss. 562.45 and 561.01(11),
25 Florida Statutes, or any other provision of law, alcoholic

26 beverages sold for consumption on the premises of a specialty
27 center by a vendor may be consumed anywhere within the specialty
28 center. An applicant for an alcoholic beverage license to be
29 located in a specialty center may not be denied licensure based
30 solely on distance from educational facilities.
31 Section 3. This act shall take effect upon becoming a law.
