1 A bill to be entitled
2 An act relating to repeal of developer incentive
3 requirements; amending ss. 125.01055 and 166.04151,
4 F.S.; removing provisions requiring counties and
5 municipalities to provide incentives to fully offset
6 costs of certain affordable housing contributions or
7 linkage fees; providing an effective date.

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. Subsection (4) of section 125.01055, Florida
12 Statutes, is amended to read:
13 125.01055 Affordable housing.—
14 (4) In exchange for a developer fulfilling the
15 requirements of subsection (2) or, for residential or mixed-use
16 residential development, the requirements of subsection (3), a
17 county must provide incentives to fully offset all costs to the
18 developer of its affordable housing contribution or linkage fee.
19 Such incentives may include, but are not limited to:
20 (a) Allowing the developer density or intensity bonus
21 incentives or more floor space than allowed under the current or
22 proposed future land use designation or zoning;
23 (b) Reducing or waiving fees, such as impact fees or water
24 and sewer charges; or
25 (c) Granting other incentives.

26 Section 2. Subsection (4) of section 166.04151, Florida
27 Statutes, is amended to read:
28 166.04151 Affordable housing.—
29 (4) In exchange for a developer fulfilling the
30 requirements of subsection (2) or, for residential or mixed-use
31 residential development, the requirements of subsection (3), a
32 municipality must provide incentives to fully offset all costs
33 to the developer of its affordable housing contribution or
34 linkage fee. Such incentives may include, but are not limited
35 to:
36 (a) Allowing the developer density or intensity bonus
37 incentives or more floor space than allowed under the current or
38 proposed future land use designation or zoning;
39 (b) Reducing or waiving fees, such as impact fees or water
40 and sewer charges; or
41 (c) Granting other incentives.
42 Section 3. This act shall take effect July 1, 2021.
