2 An act relating to insurance coverage for breast
3 cancer tests and procedures; creating ss. 627.42394
4 and 641.3133, F.S.; defining terms; prohibiting
5 certain health insurance policies and health
6 maintenance contracts from applying cost-sharing
7 requirements to certain breast cancer tests and
8 procedures; authorizing the Financial Services
9 Commission to adopt rules; providing an effective
10 date.

12 Be It Enacted by the Legislature of the State of Florida:

14 Section 1. Section 627.42394, Florida Statutes, is created
15 to read:
16 627.42394 Coverage for diagnostic mammograms, breast
17 magnetic resonance imaging scans, and breast ultrasounds.—
18 (1) As used in this section, the term:
19 (a) "Cost sharing" has the same meaning as in s.
20 627.42391.
21 (b) "Health care provider" means a physician licensed
22 under chapter 458 or chapter 459, a physician assistant licensed
23 under chapter 458 or chapter 459, or an advanced practice
24 registered nurse licensed under chapter 464.
25 (2) An individual or group, blanket, or franchise health

26 insurance policy delivered, issued for delivery, renewed,
27 amended, or continued in this state which provides coverage for
28 diagnostic mammograms, breast magnetic resonance imaging scans,
29 or breast ultrasounds may not apply cost-sharing requirements
30 for a diagnostic mammogram, breast magnetic resonance imaging
31 scan, or breast ultrasound, respectively, which is ordered by an
32 insured's health care provider.
33 (3) The commission may adopt rules to administer this
34 section.
35 Section 2. Section 641.3133, Florida Statutes, is created
36 to read:
37 641.3133 Coverage for diagnostic mammograms, breast
38 magnetic resonance imaging scans, and breast ultrasounds.—
39 (1) As used in this section, the term:
40 (a) "Cost sharing" has the same meaning as in s. 641.313.
41 (b) "Health care provider" means a physician licensed
42 under chapter 458 or chapter 459, a physician assistant licensed
43 under chapter 458 or chapter 459, or an advanced practice
44 registered nurse licensed under chapter 464.
45 (2) A health maintenance contract delivered, issued for
46 delivery, renewed, amended, or continued in this state which
47 provides coverage for diagnostic mammograms, breast magnetic
48 resonance imaging scans, or breast ultrasounds may not apply
49 cost-sharing requirements for a diagnostic mammogram, breast
50 magnetic resonance imaging scan, or breast ultrasound,

51 respectively, which is ordered by a subscriber's health care
52 provider.
53 (3) The commission may adopt rules to administer this
54 section.
55 Section 3. This act shall take effect January 1, 2022.
