II.Summary of Amendments Contained in Message:
House Amendment 1:
Extends the deadline for utilities to fully implement a plan to eliminate surface water
discharges to January 1, 2032, from January 1, 2028.
Eliminates the hardship conditions available under the bill, which authorize surface water
discharges for utilities with various hardships.
Deletes the requirement that a plan to eliminate surface water discharges and certain
applicable environmental and public health protection requirements be included in a utility’s
operating permit.
Clarifies that approval or modification of a plan by the Department of Environmental
Protection does not constitute final agency action.
Provides that the bill provisions do not apply to certain domestic wastewater treatment
facilities operated by an operator of a mobile home park.
Provides for a 25 percent density or intensity bonus to a developer or homebuilder if at least
75 percent of a proposed or existing development will have a graywater system installed or a
35 percent bonus if 100 percent of a proposed or existing development will have a graywater
system installed, in addition to any bonus provided by a county, municipality or special
district ordinance in effect on July 1, 2021.
Provides that the required maintenance of a graywater system is the responsibility of a
residential homeowner, not the manufacturer.
