1 A bill to be entitled
2 An act relating to municipal law enforcement agencies;
3 creating s. 166.0491, F.S.; specifying that
4 discussions between the chief executive officer of a
5 municipality or a representative thereof and the
6 municipality’s governing body regarding disciplinary
7 measures for municipal law enforcement officers which
8 are proposed for inclusion in a collective bargaining
9 agreement are subject to public meetings requirements;
10 requiring the governing body of a municipality to
11 solicit comments and input from the general public and
12 relevant advocacy or special interest groups in the
13 review and development of officer disciplinary
14 procedures in collective bargaining agreements;
15 requiring the governing body of a municipality to
16 ratify officer disciplinary procedures before their
17 inclusion in a collective bargaining agreement entered
18 into or renewed on or after a specified date;
19 providing an effective date.

21 Be It Enacted by the Legislature of the State of Florida:
22
23 Section 1. Section 166.0491, Florida Statutes, is created
24 to read:
25 166.0491 Municipal law enforcement agencies; adoption of
26 officer disciplinary procedures.—
27 (1) Notwithstanding s. 447.605(1), discussions between the
28 chief executive officer of a municipality, or his or her
29 representative, and the municipality’s governing body regarding
30 disciplinary procedures for municipal law enforcement officers
31 which are proposed for inclusion in a collective bargaining
32 agreement are public meetings subject to s. 286.011 and s.
33 24(b), Art. I of the State Constitution.
34 (2) For any collective bargaining agreement governing
35 municipal law enforcement officers which is entered into or
36 renewed on or after July 1, 2021, the governing body of a
37 municipality must:
38 (a) Solicit comments and input from the general public and
39 any relevant advocacy or special interest groups regarding the
40 review and development of disciplinary procedures for municipal
41 law enforcement officers before any such procedures are
42 incorporated in a collective bargaining agreement. Following the
43 solicitation of public comment, the governing body of a
44 municipality shall consider any recommendations made by the
45 general public and any relevant advocacy or special interest
46 groups.
47 (b) Ratify proposed disciplinary procedures by a majority
48 vote of the governing body members at a public meeting before
49 any terms and conditions regarding disciplinary measures may be
50 incorporated in a collective bargaining agreement by the
51 municipality and the bargaining agent.
52 Section 2. This act shall take effect July 1, 2021.
