                   IN THE COUNCIL OF THE DISTRICT OF COLUMBIA

                                        February 7, 2023

To declare the existence of an emergency with respect to the need to approve Modification Nos.

       3, 4, 5, 6, and 7 to Contract No. CW66162 with Tetra Tech, Inc. to provide engineering

       consulting services to support investigation and remediation of Anacostia River

       sediments, and to authorize payment for the goods and services received and to be

       received under the contract.

        RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this

resolution may be cited as the “Modification Nos. 3, 4, 5, 6, and 7 to Contract No. CW66162

with Tetra Tech, Inc. Approval and Payment Authorization Emergency Declaration Resolution

of 2023”.

        Sec. 2. (a) There exists an immediate need to approve Modification Nos. 3, 4, 5, 6, and 7

to Contract No. CW66162 with Tetra Tech, Inc. to provide engineering consulting services to

support investigation and remediation of Anacostia River sediments and to authorize payment for

the goods and services received and to be received under the contract.

        (b) By Modification No. 3, the Office of Contracting and Procurement, on behalf of the

Department of Energy and Environment, exercised Option Year One of Contract No. CW66162

for $0 for the period April 15, 2022, through April 14, 2023.

        (c) Modification No. 4 increased the amount to $1 million.

        (d) Modification No. 5 increased the amount by $4 million to a total of $5 million.

        (e) Modification No. 6 was an administrative modification.

        (f) Modification No. 7 increased the amount by $5 million to a total of $10 million for

Option Year One.

         (g) Council approval is necessary as these modifications increased the value of the

contract by more than $1 million during a 12-month period.

         (h) Approval is necessary to allow the continuation of these vital services. Without this

approval, Tetra Tech, Inc. cannot be paid for the goods and services provided in excess of $1

million for the period from April 15, 2022, through April 14, 2023.

       Sec. 3. The Council of the District of Columbia determines that the circumstances

enumerated in section 2 constitute emergency circumstances making it necessary that the

Modification Nos. 3, 4, 5, 6, and 7 to Contract No. CW66162 with Tetra Tech, Inc. Approval and

Payment Authorization Emergency Act of 2023 be adopted after a single reading.

       Sec. 4. This resolution shall take effect immediately.
