To declare the existence of an emergency with respect to the need to amend the Advisory
Neighborhood Commission Boundaries Act of 2022 to adjust a portion of the boundary
between single-member districts 6D01 and 6D07 in an offshore area that is occupied by
recently constructed wharves.
RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this
resolution may be cited as the Advisory Neighborhood Commission Boundaries Amendment
Emergency Declaration Resolution of 2022.
Sec. 2. (a) The Council enacted Advisory Neighborhood Commission Boundaries Act of
2022, effective August 10, 2022 (D.C. Law 24-148; D.C. Official Code 1-207.38, note), to
establish new boundaries for every Advisory Neighborhood Commission (ANC) and single-
member district (SMD).
(b) The new ANC and SMD boundaries were used for the November 8, 2022 election and
will take effect for all other purposes on January 2, 2023.
(c) Newly available aerial photographs show that a portion of the new boundary between
SMDs 6D01 and 6D07 runs through an offshore commercial building and cuts across residential
piers that are used as boat slips.
(d) To avoid confusion about the SMD assignment of the commercial building and the
residential piers, it is necessary to change the boundary so that SMD 6D01 encompasses all of
the offshore area of the Washington Channel from the Tidal Basin to Southwest Waterfront Park.
(e) This boundary change is not expected to alter the SMD assignment of any voters but
is expected to increase the 2020 Census population of SMD 6D01 to 2,122, resulting in a relative
population deviation of 6.1% (greater than 5%) from the approximate SMD population of 2,000
set by section 4(a) of the Advisory Neighborhood Commissions Act of 1975, effective October
10, 1975 (D.C. Law 1-21; D.C. Official Code 1-309.03(a)). This deviation results from the
limitations of Census geography and from the need to promote the public policies of respecting
the natural geography of the Washington Channel in the area of the Wharf and the cohesiveness
of the Wharfs liveaboard community. Therefore, the Council intends the deviation to accord
with section 3(e) of the Redistricting Procedure Act of 1981, effective March 16, 1982 (D.C.
Law 4-87; D.C. Official Code 1-1041.02(e)).

(f) The Council desires to change the SMD boundaries as described in this section before
the new boundaries take effect on January 2, 2023.
Sec. 3. The Council of the District of Columbia determines that the circumstances
enumerated in section 2 constitute emergency circumstances making it necessary that the
Advisory Neighborhood Commission Boundaries Amendment Emergency Amendment Act of
2022 be adopted after a single reading.
Sec. 4. This resolution shall take effect immediately.
