14 To amend the District of Columbia Code to enact a statute that would require the Mayor
15 to ensure that General Contractors and Construction Companies operating in the
16 District of Columbia provide a report to the Department of Employment Services
17 (DOES) specifying cause for the mass termination of employees; and to prevent
18 these companies from using DC resident information to meet requirements for
19 operating in the District of Columbia; and to mandate fines and penalties for non-
20 compliance.

22 BE IT ENACTED BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this
23 act may be cited as the Employment Equity and Transparency in Construction Act of 2021.
24 Sec. 2. Definitions.
25 For the purposes of this act, the term:
26 (1) General contractor means a main contractor responsible for the daily
27 oversight of a construction site.
28 (2) Mass termination means an employer termination of 50 or more employees.
29 Sec. 3.
30 (a) The Mayor shall general contractors and construction companies operating in the
31 District of Columbia to provide a written report to DOES specifying cause for the
32 mass termination of employees;

33 (b) The Mayor shall require a report specifying cause for mass termination of employees
34 to address the following factors: performance, violation of company policy,
35 insubordination, attendance, sexual harassment or other discriminatory behaviors,
36 physical violence, or threats;
37 (c) The Mayor shall require that no general contractor or construction company may
38 utilize the personal information of terminated employees to meet the companys
39 requirements for doing business in the District of Columbia;
40 (d) The Mayor shall require a fine, operation penalty or reinstatement of terminated
41 employees where just cause for mass termination is unjustified;
42 (e) The Mayor pursuant to Title I of the District of Columbia Administrative Procedure
43 Act, approved October 21, 1968 (82 Stat. 1204; D.C. Official Code 2-501 et seq.), may
44 issue rules to implement this act.
45 Sec. 4. Fiscal impact statement.
46 The Council adopts the fiscal impact statement in the committee report as the fiscal
47 impact statement required by section 4a of the General Legislative Procedures Act of 1975,
48 approved October 16, 2006 (120 Stat. 2038; D. C. Official Code 1-301.47a).
49 Sec. 5. Effective date.
50 This act shall take effect following approval by the Mayor (or in the event of veto by the
51 Mayor, action by the Council to override the veto), a 30-day period of congressional review as
52 provided in section 602(c)(1) of the District of Columbia Home Rule Act, approved December
53 24, 1973 (87 Stat. 813; D.C. Official Code 1-206.02(c)(1)), and publication in the district of
54 Columbia Register.
