A RESOLUTION

IN THE COUNCIL OF THE DISTRICT OF COLUMBIA

To declare the existence of an emergency with respect to the need to amend section 47-363 of
the District of Columbia Official Code to allow reprogramming requests to be submitted
during a recess of the Council; and to amend the Coronavirus Support Temporary
Amendment Act of 2021 to revise the work-search requirement for unemployment
insurance and to clarify the authority of the Mayor to enter into an agreement with a
Business Improvement District corporation for the maintenance and improvement of
District-owned assets or public space.
RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this
resolution may be cited as the Recess Reprogramming Emergency Declaration Resolution of
2021.
Sec. 2. (a) On July 13, 2021, the Council adopted changes to its rules regarding
transmittal of contracts, reprogramming requests, and grant budget modification requests during
the Councils summer recess.
(b) It has come to the Councils attention that a clarifying conforming change is
necessary to the District of Columbia Official Code to allow reprogramming requests to be
transmitted during the Councils summer recess.
(c) This legislation is related to the COVID-19 pandemic in that the Executive has
indicated a need to submit reprogramming requests to the Council during recess as a result of
federal pandemic relief funds being sent to the District.
(d) The Coronavirus Support Temporary Amendment Act, effective June 24, 2021 (D.C.
Law 24-9; 68 DCR 4824) (Coronavirus Temporary Act), contains a provision that waives
work-search requirements for individuals receiving unemployment assistance during the
pandemic.
(e) With businesses reopening, hiring improving, and the end of federally funded
unemployment benefits in early September, the District must begin to transition its
unemployment compensation program to normal operations. Therefore, the work-search
requirement in the District should resume on August 30, 2021, the day most DCPS students go
back to the classroom.
(f) The Public Space Maintenance Temporary Act of 2020, effective December 23, 2020
(D.C. Law 23-175; 67 DCR 13238) (Public Space Temporary Act), as amended by the Public

Space Maintenance and Arts Clarification Temporary Amendment Act of 2020, effective March
16, 2021 (D.C. Law 23-262; 68 DCR 1186), will expire on August 4, 2021. The Public Space
Temporary Act authorized the Mayor to enter into an agreement with a Business Improvement
District corporation for the maintenance and improvement of public space and was limited to the
COVID-19 pandemic.
(g) The Mayor has indicated that the public-health emergency will not continue after July
25, 2021, but it is still necessary to continue this authority like most other provisions of the
Coronavirus Temporary Act through November 5, 2021. This legislation would amend the
Coronavirus Temporary Act to add expiring language contained in the Public Space Temporary
Act.
Sec. 3. The Council of the District of Columbia determines that the circumstances
enumerated in section 2 constitute emergency circumstances making it necessary that the Recess
Reprogramming Emergency Amendment Act of 2021 be adopted after a single reading.
Sec. 4. This resolution shall take effect immediately.
