                   IN THE COUNCIL OF THE DISTRICT OF COLUMBIA

                                          April 6, 2021

To declare the existence of an emergency with respect to the need to approve Modification Nos.

       5, 6, and 9 to Contract No. CW63336 with Adrian L. Merton to provide HVAC

       preventive maintenance for the Department of Corrections, and to authorize payment for

       the goods and services received and to be received under the modifications.

        RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this

resolution may be cited as the Modification Nos. 5, 6 and 9 to Contract No. CW63336 with

Adrian L. Merton Approval and Payment Authorization Emergency Declaration Resolution of

2021.

        Sec. 2. (a) There exists a need to approve Modification Nos. 5, 6, and 9 to Contract No.

CW63336 with Adrian L. Merton to provide HVAC preventive maintenance for the Department

of Corrections and to authorize payment for the goods and services received and to be received

under the modifications.

        (b) By Modification No. 5, the Office of Contracting and Procurement (OCP), on

behalf of the Department of Corrections, exercised Option Year 2 of Contract No. CW63336 for

the period of March 20, 2020, through March 19, 2021, in the not-to-exceed amount of

$913,920.

        (c) By Modification No. 6, OCP increased the not-to-exceed amount for Option Year 2

by $86,080 to the not-to-exceed amount of $1 million.

        (d) Modification Nos. 7 and 8 were administrative modifications.

        (e) Modification No. 9 is now necessary, which will increase the total not-to-exceed

amount for Option Year 2 to $1.75 million.

        (f) Council approval is necessary as the modifications will increase the value of the

contract by more than $1 million during a 12-month period.

        (g) Approval is necessary to allow the continuation of these vital services. Without this

approval, Adrian L. Merton cannot be paid for goods and services provided in excess of $1

million for the period of March 20, 2020, through March 19, 2021.

       Sec. 3. The Council of the District of Columbia determines that the circumstances

enumerated in section 2 constitute emergency circumstances making it necessary that the

Modification Nos. 5, 6 and 9 to Contract No. CW63336 with Adrian L. Merton Approval and

Payment Authorization Emergency Act of 2021 be adopted after a single reading.

       Sec. 4. This resolution shall take effect immediately.
