IN THE COUNCIL OF THE DISTRICT OF COLUMBIA
April 6, 2021
To declare the existence of an emergency with respect to the need to approve Modification Nos.
8, 9, 10, 11, 12, and 13 to Human Care Agreement No. RM-17-HCA-SATSR-005-FCR-
BY4-CPS with Federal City Recovery Services, Inc. to provide Level III substance abuse
treatment services, and to authorize payment for the goods and services received and to
be received under the modifications.
RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this
resolution may be cited as the Modifications to Human Care Agreement No. RM-17-HCA-
SATSR-005-FCR-BY4-CPS with Federal City Recovery Services, Inc. Approval and Payment
Authorization Emergency Declaration Resolution of 2021.
Sec. 2. (a) There exists an immediate need to Modification Nos. 8, 9, 10, 11, 12, and 13
to Human Care Agreement No. RM-17-HCA-SATSR-005-FCR-BY4-CPS with Federal City
Recovery Services, Inc. to provide Level III substance abuse treatment services and to authorize
payment for the goods and services received and to be received under the modifications.
(b) By Modification No. 8, dated July 20, 2020, the Office of Contracting and
Procurement (OCP), on behalf of the Department of Behavioral Health, executed a partial
option of option year 3 from July 21, 2020, through September 30, 2020, in the not-to-exceed
amount of $100,000.
(c) By Modification No. 9, dated August 28, 2020, OCP extended partial option year 3
from September 30, 2020, through December 31, 2020, but added no money to the contract.
(d) By Modification No. 10, dated October 26, 2020, OCP executed an additional partial
option of option year 3 from December 31, 2020, through January 31, 2021, in the not-to-exceed
amount of $890,000, increasing the total not-to-exceed amount to $990,000.
(e) By Modification No. 11, dated December 22, 2020, OCP extended partial option year
3 from January 31, 2021, through February 28, 2021, but added no money to the contract.
(f) By Modification No. 12, dated January 30, 2021, OCP extended partial option year 3
from February 28, 2021, through March 31, 2021, but added no money to the contract.

(g) Modification No. 13 is now necessary to exercise the remainder of option year 3 from
April 1, 2021, through July 20, 2021, in the not-to-exceed amount of $2.61 million, which will
increase the total not-to-exceed amount for option year 3 to $3.6 million.
(h) Council approval is necessary as this will increase the contract to more than $1
million during a 12-month period.
(i) Council approval is necessary to allow the continuation of these vital services.
Without this approval, Federal City Recovery Services, Inc. cannot be paid for goods and
services provided in excess of $1 million for the period July 21, 2020, through July 20, 2021.
Sec. 3. The Council determines that the circumstances enumerated in section 2 constitute
emergency circumstances making it necessary that the Modifications to Human Care Agreement
No. RM-17-HCA-SATSR-005-FCR-BY4-CPS with Federal City Recovery Services, Inc.
Approval and Payment Authorization Emergency Act of 2021 be adopted after a single reading.
Sec. 4. This resolution shall take effect immediately.
