Pursuant to section 451 of the District of Columbia Home Rule Act, D.C. Official Code 1-
204.51, enclosed for consideration and approval by the Councilofthe District of Columbia is a
proposed grant agreement with the Capitol Riverfront Business Improvement District (Capitol
Riverfront BID) in the amountof $1,200,000.
Under the proposed grant agreement, the Capitol Riverfront BID will manage and operate Yards
and Canal Parks, both of which are within the Capitol Riverfront BID boundaries. The BID has
performed these functions since 2010. Yards Park and Canal Park are twoofthe Distriets
destination parks and encompass a variety of unique activities including a swim fountain, ribbon-
ice skating rink, Anacostia Waterfront promenade, and entertainment gazebo. These parks also
host a variety of District-wide activities including fitness events, food tastings, concerts and pop-
up arts and cultural and educational activities. The parks sit adjacent to the Washington
Nationals ballpark, a water-taxi stop, a Metrorail station, various businesses and restaurants, and
the Navy Yard, and are in close proximity to the DC United soccer stadium, Joint Base
Anacostia Bolling, and Capitol Hill. Thus, there is a well-documented amount of foot-traffic
throughout the parks, in addition to program participants using these amenities specifically for
these activities.
While the Covid-19 health emergency has limited widescale activities at the parks, the parks still
must be maintained and improved for general use and programming, especially during warm
weather periods. The ongoing management functions includes providing for access, safety, and
activation of the parks. Ongoing maintenance, includes upkeep, improvements, and
beautification, such as landscaping, replacing and updating park lighting and electrical
systems.the replacementofcracked or unstable boardwalk areas, abatementof vermin and
sanitation measures, staffing the clean team for maintaining a clean, debris and trash free
environment, and the costs associated with liability coverage.

This is a one-year Grant only based on appropriated funds. There are no option periods allowed.
(C) The goods or services to be provided, the methods of delivering goods or services, and any
significant program changes reflected in the proposed grant:
Under the proposed grant agreement, the Grantee (Capitol Riverfront BID or BID) will
manage and operate Yards and Canal Parks within the BID boundaries. BID has performed
these functions since 2010. The Yards and Canal Parks are two of the Districts destination
parks and encompass a variety of unique activities including a swim fountain, ribbon-ice skating
rink, Anacostia Waterfront promenade and entertainment gazebo. These parks also host a variety
of District-wide activities including fitness events, food tastings, concerts and pop-up arts and
cultural and educational activities. The parks sit adjacent to the Washington Nationals Baseball
Stadium, a water-taxi and metro-rail station, various businesses and restaurants and the Navy
Yard, and the parks are in close proximity to the DC United Soccer Stadium, Joint Base

essential functions must be maintained for general usage and programming, especially during
warm weather periods. The ongoing management includes providing for the access, safety and
activation of the parks. Maintenance includes, upkeep, improvements and beautification. These
functions include landscaping contracts and the replacement of grasses, replacing and updating
park lighting and various components of the electrical systems for both the lighting and fountain
water pump systems. It also includes the replacement of cracked or unstable boardwalk areas,
abatement of vermin and sanitation measures, staffing the clean team for maintaining a clean,
debris and trash free environment, supervising and executing contractors, programs and events,
and the costs associated with liability coverage and overhead administration.
(D) The selection process, including the number of offerors, the evaluation criteria, and the
evaluation results, including price, technical or quality, and past performance components:
The Fiscal Year 2020 local budget provided DPR with funds for the purpose of management and
operations of Yards and Canal Parks by supporting these public parks and recreational/civic
spaces. The Grant is being made directly to the BID under the statutory authority granted to DPR
in the DPR Parks Adoption and Sponsorship Amendment Act of 2017, D.C. Law 10-246; D.C.
Official Code 10-304(d) (July 2018 Supp.).
(E) A description of any bid protest related to the award of the grant, including whether the
protest was resolved through litigation, withdrawal of the protest by the protestor, or
voluntary corrective action by the District. Include the identity of the protestor, the grounds
alleged in the protest, and any deficiencies identified by the District as a result of the protest:

(F) The background and qualifications of the proposed contractor, including its organization,
financial stability, personnel, and performance on past or current government or private
sector contracts with requirements similar to those of the proposed contract:
The Grantee has performed these functions since 2010.
(G) A summary of the subcontracting plan required under section 2346 of the Small, Local, and
Disadvantaged Business Enterprise Development and Assistance Act of 2005, as amended,
D.C. Official Code 2-218.01 et seq. (Act), including a certification that the subcontracting
plan meets the minimum requirements of the Act and the dollar volume of the portion of the
contract to be subcontracted, expressed both in total dollars and as a percentage of the total
contract amount:
Grantee has certified in signing the Grant that any subcontracting plans will be submitted for
review and approval for each task order agreement with a value of $250,000 or more.
(H) Performance standards and the expected outcome of the proposed contract:
The Grantee will be required to meet or exceed performance standards in accordance with
Grantees historical performance, and current trends and standards for destination parks. Grantee
has provided annual reports on performance and will continue to do so for FY21 within thirty (30)
days of the end of the performance period.
(I) The amount and date of any expenditure of funds by the District pursuant to the contract
prior to its submission to the Council for approval:
None.
(J) A certification that the proposed contract is within the appropriated budget authority for
the agency for the fiscal year and is consistent with the financial plan and budget adopted
in accordance with D.C. Official Code 47-392.01 and 47-392.02:
The Agency Fiscal Officer has certified that the proposed Contract is within the Departments
appropriated budget authority for the fiscal year and is consistent with the financial plan and budget
adopted in accordance with D.C. Official Code 47-392.01 and 47-392.02. The relevant
certification accompanies this Council Package.
(K) A certification that the contract is legally sufficient, including whether the proposed
contractor has any pending legal claims against the District:
The proposed Grant has been deemed legally sufficient by the Departments Office of the General
Counsel, and the Grantee does not appear to have any currently pending legal claims against the
District.

(L) A certification that Citywide Clean Hands database indicates that the proposed contractor
is current with its District taxes. If the Citywide Clean Hands Database indicates that the
proposed contractor is not current with its District taxes, either: (1) a certification that the
contractor has worked out and is current with a payment schedule approved by the District;
or (2) a certification that the contractor will be current with its District taxes after the District
recovers any outstanding debt as provided under D.C. Official Code 2-353.01(b):
The relevant Clean Hands Certificate accompanies this Council Package.
(M) A certification from the proposed contractor that it is current with its federal taxes, or has
worked out and is current with a payment schedule approved by the federal government:
The Grantee has certified by signing the Grant that it is in compliance with federal laws.
(N) The status of the proposed contractor as a certified local, small, or disadvantaged business
enterprise as defined in the Small, Local, and Disadvantaged Business Enterprise

This memo is to certify that the Department of Parks and Recreation (DPR), Office of the General
Counsel, has reviewed the above referenced proposed grant and has found it to be legally sufficient
subject to Council approval and any required materials. The AFO has certified the funds. Please

Our summary of the grant is below for your convenience:
Pursuant to DC Code 2-352.02 and 1 DCMR 5004, DPR is requesting Council approval of the
proposed grant, attached hereto, to be made by DPR to the Capitol Riverfront Business
Improvement District (BID) in the amount of one million and two hundred ($1,200,000.00) for
FY21.
The DPR FY21 Operating Budget provided DPR with sufficient Grant Funds for the purpose of
improving the recreational and educational opportunities for District of Columbia residents at the
Yards and Canal Parks by developing these public parks and recreational/civic spaces. The Grant
is being made directly to the Capitol Riverfront BID under the statutory authority granted to DPR
in the DPR Parks Adoption and Sponsorship Amendment Act of 2017, D.C. Law 10-246; D.C.
Official Code 10-304 (July 31, 2017) for the management and operations of the parks.

DPRs mission is to enhance the quality of life and wellness of District residents and visitors by
providing equal access to affordable and quality recreational services, by organizing programs,
activities and events, and by building and maintaining safe and beautiful open spaces and
recreational amenities.
Similarly, the Capitol Riverfront BIDs mission is to help the District to promote additional
services and improvements within a BID area which results in the welfare of the residents,
employers, employees, property owners, commercial tenants, consumers, and the general public
by preserving, maintaining, and enhancing the economic health and vitality of a BID area as both
a community and business center.
The Capital Riverfront BIDs boundaries include the parks within the geographic area described
in DC Official Code 2-1215.58, including Yards and Canal Parks. The Capitol Riverfront BID
was designated to manage and operate Yards Park on behalf of the District in an August 11, 2010
agreement between the District (through the Office of the Deputy Mayor for Planning and
Economic Development), Forest City Washington, and the Capital Riverfront BID (this agreement
expired in June 2017). The grant is intended to continue the services of the Capitol Riverfront BID
under the 2010 agreement.
Canal Park Inc., a District of Columbia non-profit corporation, is the licensee of the area known
as Canal Park, and responsible for its maintenance through a license agreement executed with the
District of Columbia on March 21, 2011. Canal Park Inc., has retained the Capitol Riverfront BID
to manage and program Canal Park in an agreement initially effective October 1, 2014 and renewed
annually.
The Capitol Riverfront BID is exempt from taxation under 501(c)(6) of the Internal Revenue
Code and is included in the Cumulative List of Organizations described in 170(c) of the
Internal Revenue Code and the Internal Revenue Service list of exempt organizations at:
http://apps.irs.gov/app/eos/. The Capitol Riverfront BID is not a private foundation within the
meaning of Section 509(a) of the Internal Revenue Code.
