15 To amend Lead Service Line Priority Replacement Assistance Act of 2004 to permit DC Water
16 to replace the portion of a lead water service line on private property where they are
17 replacing the portion on public property to is lead or non-lead; to permit DC water to
18 move forward with replacement work without waiting 24 hours for homeowner consent
19 to complete the replacement of a lead water service line on public property that DC
20 Water may complete of right; to define lead water service line to mean a service line
21 including any lead and to include a brass or galvanized service line, and to allow for
22 funds from the lead water service line payment assistance program to be used to cover the
23 cost of replacing a portion of a lead water service line remaining after a prior partial
24 replacement.

26 BE IT ENACTED BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this
27 act may be cited as the Lead Service Line Replacement Amendment Act of 2020.
28 Sec. 2. The Lead Service Line Priority Replacement Assistance Act of 2004, effective
29 March 13, 2019 (D.C. Law 22-241; D.C. Official Code 34-2151, et. seq), is amended as
30 follows:
31 (a) Section 6019a (D.C. Official Code 34-2158) is amended as follows:
32 (1) Subsection (a) is amended as follows:
33 (A) Paragraph (1) is amended by striking the phrase a lead water service
34 line that is on public property and inserting the phrase, a lead or non-lead water service line
35 that is on public property in its place.

36 (B) Paragraph (2) is amended by striking the phrase a lead water service
37 line that is on public property and inserting the phrase, a lead or non-lead water service line
38 that is on public property in its place.
39 (2) Subsection (2)(C) is amended to read as follows:
40 (C) The replacement is necessary to repair a damaged or leaking water
41 service line, and:
42 (i) Prior to commencing work to replace any portion of the water
43 service line, DC Water requests the consent of the private property owner in writing via hand
44 delivery to the property to replace the portion of the lead water service line on private property
45 and notifies the property owner of the risks due to the partial lead water service line replacement
46 in public property; and
47 (ii) DC Water replaces the lead water service line replacement in
48 private property within 30 days, where the property owner provides consent.
49 (3) A new subsection (d) is added to read as follows:
50 (d) For the purposes of this Chapter, lead water service line shall mean a service line
51 containing any lead and shall include a brass or galvanized service line.
52 (b) Section 6019b (D.C. Official Code 34-2159), is amended as follows:
53 (1) Paragraph (a) is amended by striking the phrase portion of a lead water
54 service line located on their private property if the portion of the water service line on public
55 property is not a lead water service line, whether in whole or in part. and inserting the phrase
56 eligible portion of the lead water service line. in its place.
57 (2) Paragraph (f) is amended as follows:

58 (A) Subparagraph (1) is amended by striking the phrase portion of a lead
59 water service line on private property and inserting the phrase eligible portion of the lead water
60 service line in its place.
61 (B) Subparagraph (2) is amended by striking the phrase portion of a lead
62 water service line on private property and inserting the phrase eligible portion of the lead water
63 service line in its place.
64 (3) Paragraph (g)(1) is amended to read as follows:
65 (g)(1) The property owner shall be responsible for securing and contracting with a
66 contractor for the replacement of the eligible portion of the lead water service line. When the
67 contractor completes the replacement of the eligible portion of the lead water service line, a copy
68 of the invoice for the replacement of the eligible portion of the lead water service line shall be
69 provided to DC Water.
70 (4) A new paragraph (i) is added to read as follows:
71 (i) For the purposes of this section, eligible portion of the lead water service line shall
72 mean the portion of the lead water service line located on their private property, or any portion of
73 the lead water service line remaining on public property from prior work by DC Water or a DC
74 Water contractor to complete a partial replacement.
75 Sec. 3. Fiscal impact statement.
76 The Council adopts the fiscal impact statement in the committee report as the fiscal
77 impact statement required by section 4a of the General Legislative Procedures Act of 1975,
78 approved October 16, 2006 (12 Stat. 2038; D.C. Official Code 1-301.47a).
79 Sec. 4. Effective date.

80 This act shall take effect following approval by the Mayor (or in the event of veto by the
81 Mayor, action by the Council to override the veto), a 30-day period of congressional review as
82 provided in section 602(c)(1) of the District of Columbia Home Rule Act, approved December
83 24, 1973 (87 Stat. 813; D.C. Official Code 1-206.02(c)(1)), and publication in the District of
84 Columbia Register.
