10 To amend, on a temporary basis, the Minimum Wage Act Revision Act of 1992 to provide that a
11 third-party payroll provider shall certify a tipped employee was paid the required
12 minimum wage based only on the information it receives from the employer; and to
13 amend the Commission on the Arts and Humanities Act to clarify the term requirements
14 for the Executive Director.

16 BE IT ENACTED BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this
17 act may be cited as the Substantive Technical Temporary Amendment Act of 2020.
18 Sec. 2. Section 10a(a)(1)(A) of the Minimum Wage Act Revision Act of 1992, effective
19 March 11, 2014 (D.C. Law 20-91; D.C. Official Code 32-1009.01(a)(1)(A)), is amended by
20 striking the phrase including gratuities. and inserting the phrase including gratuities based
21 upon the information given to it by the employer. in its place.
22 Sec. 3. Section 6(a)(1) of the Commission on the Arts and Humanities Act, effective
23 October 21, 1975 (D.C. Law 1-22; D.C. Official Code 39-205(a)(1)), is amended to read as
24 follows:
25 (a)(1) The Commission shall nominate, and after the advice and consent of the Council,
26 shall appoint an Executive Director for the Commission for a renewable 4-year term. The
27 Executive Director may be removed by the Commission for just and reasonable cause..

28 Sec. 4. Fiscal impact statement.
29 The Council adopts the fiscal impact statement of the Budget Director as the fiscal impact
30 statement required by section 4a of the General Legislative Procedures Act of 1975, approved
31 October 16, 2006 (120 Stat. 2038; D.C. Official Code 1-301.47a).
32 Sec. 5. Effective date.
33 (a) This act shall take effect following approval by the Mayor (or in the event of veto by
34 the Mayor, action by the Council to override the veto), a 30-day period of congressional review
35 as provided in section 602(c)(1) of the District of Columbia Home Rule Act, approved December
36 24, 1973 (87 Stat. 813; D.C. Official Code 1-602.02(c)(1)), and publication in the District of
37 Columbia Register.
38 (b) This act shall expire after 225 days of its having taken effect.
