IN THE COUNCIL OF THE DISTRICT OF COLUMBIA
To amend the Health Benefit Exchange Authority Establishment Act of 2011 and the
Procurement Practices Reform Act of 2010 to make the independent procurement
authority for the Health Benefit Exchange Authority permanent.
BE IT ENACTED BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this
act may be cited as the "Health Benefit Exchange Authority Independent Procurement Authority
30 Amendment Act of 2019".
31 Sec. 2. Section 5(a)(5) of the Health Benefit Exchange Authority Establishment Act of
32 2011, effective March 2, 2012 (D.C. Law 19-94; D.C. Official Code 31- 3171.04(a)(5)) is
33 amended by striking the phrase "consistent with" and inserting the phrase "and shall not be
34 subject to in its place.
35 Sec. 3. Section 105(c)ofthe Procurement Practices Reform Act of 2010, effective April
36 8, 2011 (D.C. Law 18-371; D.C. Official Code 2-351.05(c)), is amended by adding a new
37 paragraph (17) to read as follows:
"(17) District of Columbia Health Benefit Exchange Authority; and.
Sec. 4. Fiscal impact statement
The Council adopts the fiscal impact statement in the committee report as the fiscal
impact statement required by section 4a of the General Legislative Procedures Act of 1975,
approved October 16, 2006 (120 Stat. 2038; D.C. Official Code 1-301.47a).
Sec. 5. Effective date.
The act shall take effect following approval by the Mayor (or in the eventof veto by the
Mayor, action by the Council to override the veto), a 30-day period of congressional review as
provided in section 602(c)(1) of the District of Columbia Home Rule Act, approved December
10 24, 1973, (87 Stat. 813; D.C. Official Code 1-206.02(c)(1)), and publication in the District of
a Columbia Register.
