REASONS FOR BILL:
This bill grants the claimant, Barbara Makara, permission to sue the state in accordance with
subsection (c) of section 4-159a of the general statutes. The claimants action shall be
brought no later than one year from the date of the final adoption of this resolution by the
General Assembly.
SUBSTITUTE LANGUAGE:
The substitute language grants claimant Barbara Makara permission to sue the state. The
original language granted the Claims Commissioner a one-year extension to dispose of
Barbara Makaras claim.

NATURE AND SOURCES OF OPPOSITION:
D. Lincoln Woodard, Attorney, Walsh Woodard LLC; opposes this bill providing a detailed
history of the claim, including the related procedural issues stemming from the case. It is
stated that in 2018, the State's Counsel consented to the order authorizing suit against the
state in Superior Court. Despite this ruling, in 2019, 2020 & 2021, the Office of the Claims
Commissioner requested extensions of time to dispose of the claim. It is stated that the
committee should grant the client permission to sue based on the 2018 decision.
Claimant, Barbara Scott (Makara); opposes this bill briefly stating details of the case and
urged the committee not to grant the Claims Commissioner a one-year extension to resolve
this case and urges the committee to grant permission to sue the state.
