REASONS FOR BILL:
This bill requires a study to determine if policy changes within the Department of Children and
Families influences children's health.
The substitute language provides definitions of the following terms: Authorized owner,
Business entity, Dealer registration, Manufacturer registration, Electronic cigarette liquid,
Electronic nicotine delivery system, vapor product and Deliver/Delivering.
Further, in subsection b it is stated that no person with a certificate of dealer registration
should have the intention to sell nicotine products through an electronic nicotine delivery
system, and if there is a flavor to the nicotine product, this must be clearly advertised.
In subsection c, it is stated that the above mentioned does not apply to the seller who own an
electronic nicotine delivery system certificate of dealer and people under twenty-one years
old are no allowed to enter a business operated by such person and there must be clear
notice regarding such prohibition in all entrances of the business.
If the Commissioner of Revenue Services find that after a hearing a person with an electronic
nicotine delivery system certificate of dealer registration knowingly violated subsection b of
this act, with exception of subsection c, the commissioner will fine $300 for the first violation,
$750 for the second violation on or before 36 months after the date of the first violation. If a
third violation occurs before 36 months after the first violation the commissioner will fine the
person $1000 and any license or certificate held by the person shall be revoked.
