REASONS FOR BILL:
This bill establishes rules for commercial receiverships, excluding residential properties with
four or less units. This would bring a uniform statutory process that would hold title owners of
commercial real estate accountable in using rental income for its required purposes by the
courts. This would provide a standard for courts to apply and oversee the management and
disposition of commercial property through the appointment of a rent receiver. This uniform
bill was proposed by the Bar Association.
SUBSTITUTE LANGUAGE:
The substitute language changed the effective date to July 1, 2022 through a bipartisan
amendment the suggestion of the Judicial Branch.
RESPONSE FROM ADMINISTRATION/AGENCY:
State of Connecticut Judicial Branch does not take a stance on this bill but states that the
bills provisions conflict with the Practice Book Rules which will need to be amended by the
Rules Committee of the Superior Court. It is requested that the effective date be pushed back
in order to provide enough time to make the requested changes.
NATURE AND SOURCES OF SUPPORT:
Connecticut Bar Association, Attorney, Barry Hawkins, supports this bill stating that it will be
an effective tool in making sure rental income from commercial real estate is used for its
required purposes It is mentioned that the state of Connecticut does not have a uniform
standard set of rules, which means court decisions vary from court to court or judge to judge.
