REASONS FOR BILL:
In multiple municipalities across the state, towns have been finding an issue with being able
to fill vacancies in the towns Board of Education due to the procedure for filling a vacancy not
being in a clear and concise manner throughout the state because of a conflict with statutes
in Title 7 and Title 10.
HB 6108 allows for 2 paths for the Board of Education to take: If there are more than 60 days
left in the vacancy, the Board of Education members will appoint and fill that vacancy. If there
are less than 60 days left in the vacancy, the Board of Education members will not fill the
vacancy and will wait until the next town election. If there is no one who takes the oath of
office for the Board of Education within either 60 days of election or appointment, then the
seat is considered vacant.
