AN ACT CONCERNING VACANCIES IN CONSTITUTIONAL
EXECUTIVE BRANCH OFFICES.
Be it enacted by the Senate and House of Representatives in General
Assembly convened:
1 Section 1. Section 9-213 of the general statutes is repealed and the
2 following is substituted in lieu thereof (Effective October 1, 2021):
3 [(a)] If the office of Secretary of the State, [or] Comptroller, Attorney
4 General or Treasurer becomes vacant, the General Assembly, if in
5 session, shall fill [it] such office; but, if the vacancy occurs when the
6 General Assembly is not in session or if the General Assembly fails to
7 make an appointment to fill the vacancy, [it shall be filled by] the
8 Governor shall appoint a person to serve as acting Secretary of the State,
9 Comptroller, Attorney General or Treasurer, as applicable, until the next
10 regular session of the General Assembly at which time the Governor
11 shall nominate a successor for such office who shall be subject to
12 approval by the General Assembly.
13 [(b) Any vacancy in the office of Attorney General shall be filled by
14 appointment by the Governor for the unexpired portion of the term.

15 (c) (1) If the office of the Treasurer becomes vacant, the General
16 Assembly, if in session, shall fill the vacancy for the unexpired portion
17 of the term. (2) If the vacancy occurs when the General Assembly is not
18 in session, or if the General Assembly fails to make an appointment to
19 fill the vacancy and the vacancy does not occur in the year in which a
20 state election is to be held for the office of the Treasurer, the Governor
21 shall appoint a person to serve as acting Treasurer until the next regular
22 session of the General Assembly at which time the Governor shall
23 nominate a successor for the office of Treasurer who shall be subject to
24 approval by the General Assembly. (3) If the vacancy occurs when the
25 General Assembly is not in session or if the General Assembly fails to
26 make an appointment to fill the vacancy and the vacancy occurs in the
27 year in which a state election is to be held for the office of the Treasurer,
28 the Deputy Treasurer shall fill the vacancy for the unexpired portion of
29 the term.]
This act shall take effect as follows and shall amend the following
sections:
Section 1 October 1, 2021 9-213
Statement of Purpose:
To align for all constitutional executive branch offices the manner in
which any vacancy therein is filled.
