AN ACT CONCERNING THE RESPONSIBILITIES OF COURT-
APPOINTED CONSERVATORS AND THE RIGHTS OF CONSERVED
PERSONS.
Be it enacted by the Senate and House of Representatives in General
Assembly convened:
1 That chapter 802h of the general statutes be amended to provide that:
2 (1) The Probate Court shall not appoint a conservator for any person
3 unless the court has explored all alternatives to conservatorship and has
4 given due consideration to the wishes of family and friends of the
5 person for whom conservatorship is sought; (2) no person who is
6 appointed as a conservator shall make final decisions on the sale of
7 assets or finances of the conserved person, or the appropriateness of
8 medical treatment for the conserved person, without initially consulting
9 the family members of the conserved person; (3) in the absence of heirs
10 or family members, any real or personal property of the conserved
11 person shall be transferred to the state upon the death of the conserved
12 person; (4) prior to the appointment of any conservator, the person for
13 whom conservatorship is sought shall undergo a full medical evaluation
14 by an impartial medical provider, which evaluation shall also include
15 interviews with family members; (5) the rights and responsibilities of

16 conservators shall be clearly communicated to the conserved person and
17 his or her family members in a language that is readily understood by
18 such persons; (6) no conservator may prohibit family or friends of the
19 conserved person from visiting such person in a hospital, nursing home
20 or private residence; and (7) the conserved person and family members
21 of the conserved person shall have the right to request a change in
22 conservator at any time.
Statement of Purpose:
To clarify the responsibilities of court-appointed conservators and the
rights of a conserved person.
