AN ACT CONCERNING VEGETATION MANAGEMENT BY THE
DEPARTMENT OF TRANSPORTATION.
Be it enacted by the Senate and House of Representatives in General
Assembly convened:
1 Section 1. (NEW) (Effective from passage) Notwithstanding any
2 provision of the general statutes, the Department of Transportation,
3 prior to conducting any tree removal project that is one acre or larger in
4 size and that is adjacent to any state highway, shall assess whether such
5 project will destroy or adversely modify essential habitat designated
6 pursuant to section 26-306 of the general statutes, so as to reduce the
7 viability of the habitat to support endangered or threatened species or
8 so as to kill, injure or appreciably reduce the likelihood of survival of
9 the species. A copy of any such assessment shall be provided by the
10 Commissioner of Transportation to the Commissioner of Energy and
11 Environmental Protection and the joint standing committee of the
12 General Assembly having cognizance of matters relating to the
13 environment prior to commencing any such project.

This act shall take effect as follows and shall amend the following
sections:

conducting certain tree removal projects along state highways.
