AN ACT CONCERNING NUISANCE CALLS.
Be it enacted by the Senate and House of Representatives in General
Assembly convened:
1 Section 1. Subsection (b) of section 42-288a of the general statutes is
2 repealed and the following is substituted in lieu thereof (Effective July 1,
3 2020):
4 (b) (1) The department shall establish and maintain a "no sales
5 solicitation calls" listing of consumers who do not wish to receive
6 unsolicited telephonic sales calls. The department may contract with a
7 private vendor to establish and maintain such listing, provided [(1)] (A)
8 the private vendor has maintained national "no sales solicitation calls"
9 listings for more than two years, and [(2)] (B) the contract requires the
10 vendor to provide the "no sales solicitation calls" listing in a printed hard
11 copy format and in any other format offered at a cost that does not
12 exceed the production cost of the format offered. The department shall
13 provide notice to consumers of the establishment of a "no sales
14 solicitation calls" listing. Any consumer who wishes to be included on
15 such listing shall notify the department by calling a toll-free number
16 provided by the department, or in any other such manner and at such

17 times as the commissioner may prescribe. A consumer on such listing
18 shall be deleted from such listing upon the consumer's written request.
19 The department shall update such listing not less than quarterly and
20 shall make such listing available to telephone solicitors and other
21 persons upon request.
22 (2) A telemarketer who makes a telephonic sales call to a consumer
23 shall inform the consumer that he or she may request that his or her
24 telephone number be added to the "no sales solicitation calls" listing. If
25 the consumer requests that his or her telephone number be added to
26 such listing, the telemarketer shall add the consumer's telephone
27 number to such listing not later than three business days after the
28 customer's request.
This act shall take effect as follows and shall amend the following
sections:
Section 1 July 1, 2020 42-288a(b)
Statement of Purpose:
To require telemarketers to inform consumers they may request their
telephone numbers to be placed on the do not call list.
