AN ACT CONCERNING THE USE OF LOCAL CAPITAL
IMPROVEMENT FUND GRANTS FOR THE REMOVAL AND TRIMMING
OF CERTAIN TREES.
Be it enacted by the Senate and House of Representatives in General
Assembly convened:
1 Section 1. Subsection (a) of section 7-536 of the general statutes is
2 repealed and the following is substituted in lieu thereof (Effective July 1,
3 2020):
4 (a) As used in sections 7-535 to 7-538, inclusive:
5 (1) "Adjusted equalized net grand list per capita" means the adjusted
6 equalized net grand list per capita determined for each town pursuant
7 to section 10-261;
8 (2) "Density" means the population of a municipality divided by the
9 number of square miles of the municipality;
10 (3) "Grant anticipation note" means a note issued in anticipation of
11 the receipt of project grants to the municipality from moneys in the
12 Local Capital Improvement Fund;

13 (4) "Local capital improvement project" means a municipal capital
14 expenditure project for any of the following purposes: (A) Road
15 construction, renovation, repair or resurfacing, (B) sidewalk and
16 pavement improvements, (C) construction, renovation, enlargement or
17 repair of sewage treatment plants and sanitary or storm, water or sewer
18 lines, including separation of lines, (D) public building construction
19 other than schools, including renovation, repair, code compliance,
20 energy conservation and fire safety projects, (E) construction,
21 renovation, enlargement or repair of dams, bridges and flood control
22 projects, (F) construction, renovation, enlargement or repair of water
23 treatment or filtration plants and water mains, (G) construction,
24 renovation or enlargement of solid waste facilities, (H) improvements to
25 public parks, (I) the preparation and revision of local capital
26 improvement plans projected for a period of not less than five years and
27 so prepared as to show the general description, need and estimated cost
28 of each individual capital improvement, (J) improvements to emergency
29 communications systems and building security systems, including for
30 schools, (K) public housing projects, including renovations and
31 improvements and energy conservation and the development of
32 additional housing, (L) renovations to or construction of veterans'
33 memorial monuments, (M) thermal imaging systems, (N) bulky waste
34 and landfill projects, (O) the preparation and revision of municipal
35 plans of conservation and development adopted pursuant to section 8-
36 23, provided such plans are endorsed by the legislative body of the
37 municipality not more than one hundred eighty days after adoption by
38 the commission, (P) acquisition of automatic external defibrillators, (Q)
39 floodplain management and hazard mitigation activities, (R) on-board
40 oil refining systems consisting of a filtration canister and evaporation
41 canister that remove solid and liquid contaminants from lubricating oil,
42 (S) activities related to the planning of a municipal broadband network,
43 provided the speed of the network shall be not less than three hundred
44 eighty-four thousand bits per second, (T) establishment of bikeways and
45 greenways, (U) land acquisition, including for open space, and costs
46 involved in making land available for public uses, (V) acquisition of

47 technology related to implementation of the Department of Education's
48 common core state standards, (W) technology upgrades, including for
49 improvements to expand public access to government information
50 through electronic portals and kiosks, [and] (X) for the fiscal years
51 ending June 30, 2013, and June 30, 2014, acquisition of snow removal
52 equipment, capital expenditures made to improve public safety, and
53 capital expenditures made to facilitate regional cooperation, and (Y) for
54 hazardous tree removal and trimming of nonutility-related hazardous
55 trees, tree limbs and tree branches on municipal property or within a
56 municipal right-of-way. "Local capital improvement project" means
57 only capital expenditures and includes repairs incident to
58 reconstruction and renovation but does not include ordinary repairs
59 and maintenance of an ongoing nature. As used in this subdivision,
60 "floodplain management" and "hazard mitigation" have the same
61 meanings as provided in section 25-68j;
62 (5) "Municipality" means any town, city, borough, consolidated town
63 and city or consolidated town and borough;
64 (6) "Population" means the number of persons according to the most
65 recent federal decennial census, except that, in intervening years
66 between such censuses, "population" means the number of persons
67 according to the most recent estimate of the Department of Public
68 Health; and
69 (7) "Secretary" means the Secretary of the Office of Policy and
70 Management.
This act shall take effect as follows and shall amend the following
sections:

Statement of Purpose:
To authorize municipalities to use local capital improvement fund
grants to remove and trim certain hazardous trees, limbs and branches.
