AN ACT CONCERNING SAFE BOATING.
Be it enacted by the Senate and House of Representatives in General
Assembly convened:
1 Section 1. Subsection (a) of section 15-140g of the general statutes is
2 repealed and the following is substituted in lieu thereof (Effective from
3 passage):
4 (a) Any person required to obtain a safe boating certificate or proof
5 of boating safety education pursuant to section 15-140e, as amended by
6 this act, shall have such certificate or proof on board at all times while
7 operating a vessel. On demand of an officer authorized to enforce the
8 provisions of this chapter, such person shall exhibit the certificate to the
9 officer. For purposes of compliance with this section, such certificate or
10 proof may be exhibited in electronic form on a mobile electronic device.
11 Sec. 2. Subsection (g) of section 15-140j of the general statutes is
12 repealed and the following is substituted in lieu thereof (Effective from
13 passage):
14 (g) Any person required to obtain a certificate of personal watercraft
15 operation or proof of safe personal watercraft handling education

16 pursuant to this section shall have such certificate or proof on board at
17 all times while operating a personal watercraft. On demand of an officer
18 authorized to enforce the provisions of this chapter, such person shall
19 exhibit the certificate to the officer. For purposes of compliance with this
20 section, such certificate or proof may be exhibited in electronic form on
21 a mobile electronic device.
22 Sec. 3. Subsections (a) and (b) of section 15-140j of the general statutes
23 are repealed and the following is substituted in lieu thereof (Effective
24 from passage):
25 (a) As used in this section, "personal watercraft" is any inboard
26 powered vessel less than sixteen feet in length that has [an internal
27 combustion engine powering] a water-jet pump as its primary source of
28 motor propulsion and that is designed to be operated by a person
29 sitting, standing or kneeling on the vessel, rather than the conventional
30 manner of sitting or standing inside the vessel, "jetted articulated vessel"
31 or "JAV" has the same meaning as provided in section 15-127 and
32 "operator of a JAV" means any person who, in whole or in part, from
33 such person's position on the JAV can: (1) Energize or de-energize the
34 JAV, or (2) control or partially control the thrust, speed or direction of
35 the JAV.
36 (b) No person shall operate a personal watercraft or a JAV unless such
37 person has been issued a certificate of personal watercraft operation by
38 the Commissioner of Energy and Environmental Protection or a valid
39 vessel operator license or certificate of personal watercraft operation
40 issued by another state or an agent of such state approved to issue such
41 certificate or license. Such license or certificate issued by another state
42 or agent of another state shall contain the mark or logo of the National
43 Association of State Boating Law Administrators or other mark as
44 approved by the Commissioner of Energy and Environmental
45 Protection and shall be issued by such other state or agent on or after
46 January 1, 2008, to be deemed valid. No person less than sixteen years
47 of age shall operate a JAV. No owner of a personal watercraft or a JAV
48 shall knowingly authorize or permit a person who is less than sixteen

49 years of age who does not have a certificate of personal watercraft
50 operation issued by the commissioner to operate such personal
51 watercraft or JAV on the waters of the state. Notwithstanding the
52 provisions of this section, the commissioner may modify or suspend, by
53 written permission, any age or certification requirement set forth in this
54 section for the purpose of a marine event held pursuant to section 15-
55 140b. In those waters where the United States Coast Guard has
56 jurisdiction over marine events, such permit shall not be valid unless
57 and until the commissioner receives a copy of the United States Coast
58 Guard authorization for a marine event.
59 Sec. 4. Subsection (a) of section 15-149a of the general statutes is
60 repealed and the following is substituted in lieu thereof (Effective from
61 passage):
62 (a) Any person operating a vessel upon the waters of this state which
63 vessel is in any manner involved in an accident in which any person
64 dies, is injured so as to require medical attention, or disappears, shall
65 immediately notify the nearest law enforcement agency having
66 jurisdiction over such accident and, not later than forty-eight hours after
67 such accident, report the matter in writing to the Commissioner of
68 Energy and Environmental Protection. The report shall be on a form
69 prescribed by the commissioner and shall state as accurately as possible
70 the time, place and cause of such accident, the injuries occasioned by the
71 accident and any other facts the commissioner deems necessary. If such
72 operator is physically incapable of notifying the nearest law
73 enforcement agency or of making such report and there is another
74 participant or passenger in the accident not incapacitated, such
75 participant or passenger shall immediately notify the nearest law
76 enforcement agency having jurisdiction over such accident and make
77 the report to the commissioner not later than forty-eight hours after such
78 accident. Any person operating a vessel upon the waters of this state
79 which is in any manner involved in an accident in which the total
80 damages to all property affected by such accident, including property
81 of such operator, is in excess of [five hundred] two thousand dollars,
82 such person shall, not later than five days after such accident, report the

83 matter in writing to the commissioner on such forms as said
84 commissioner may prescribe. If there is no person other than the owner
85 capable of making such report or if the report has not been submitted
86 and the owner of such vessel is not incapacitated, such owner shall, not
87 later than five days after learning of the facts of such accident, report the
88 matter to the commissioner, on such forms as said commissioner may
89 prescribe. Any such operator of a vessel, or surviving participant or
90 passenger in any such accident, or the owner of the vessel involved in
91 any such accident, shall provide any other information or additional
92 report as the commissioner shall require. Failure of any person to
93 comply with any provision of this subsection shall be an infraction.
94 Sec. 5. Subsections (d) and (e) of section 15-154 of the general statutes
95 are repealed and the following is substituted in lieu thereof (Effective
96 from passage):
97 (d) Upon the immediate approach of a law enforcement vessel using
98 an audible signal device [and] or flashing blue lights or a fire rescue
99 vessel using an audible signal device [and] or flashing red or yellow
100 lights, any person operating a vessel shall immediately slow to a speed
101 sufficient to maintain steerage only, shall alter course, within its ability,
102 so as not to inhibit or interfere with the operation of the law enforcement
103 vessel or fire rescue vessel, and shall proceed, unless otherwise directed
104 by an officer in the law enforcement vessel or fire rescue vessel, at a
105 reduced speed until beyond the area of operation of the law
106 enforcement vessel or fire rescue vessel. Any person operating a vessel
107 who wilfully or negligently obstructs or retards any law enforcement or
108 fire rescue vessel answering an emergency call or in pursuit of fleeing
109 law violators shall be fined not more than two hundred fifty dollars.
110 (e) Any person operating a vessel passing within two hundred feet of
111 a stationary law enforcement vessel using an audible signal device [and]
112 or flashing blue lights or a stationary fire rescue vessel using flashing
113 red or yellow lights shall reduce speed to a speed of slow-no-wake until
114 there is a distance of more than two hundred feet between such person's
115 vessel and the law enforcement vessel or fire rescue vessel. Any person

116 operating a vessel passing within two hundred feet of a commercial
117 vessel responding to or towing a vessel in distress when such
118 commercial vessel is displaying flashing red or yellow lights shall
119 reduce speed to a speed of slow-no-wake. For purposes of this
120 subsection, "slow-no-wake" means operation of a vessel at a speed that
121 does not produce more than a minimum wake and is not greater than
122 six miles per hour over ground, unless a higher minimum speed is
123 necessary to maintain steerage when traveling with a strong current.
124 Sec. 6. Section 15-140e of the general statutes is repealed and the
125 following is substituted in lieu thereof (Effective from passage):
126 (a) (1) No resident of the state, person owning real property in the
127 state or person owning a vessel in the state shall operate on the waters
128 of the state a vessel which is required to be registered or numbered
129 pursuant to this chapter unless such person has a valid vessel operator
130 license issued by the United States Coast Guard or has obtained a safe
131 boating certificate issued by the Commissioner of Energy and
132 Environmental Protection, provided on and after January 1, 2022, no
133 other person shall operate on the waters of the state a vessel which is
134 required to be registered or numbered pursuant to this chapter unless
135 such person possesses a valid vessel operator license issued by another
136 state or proof of successful completion of boating safety education. Such
137 license from another state or proof of boating safety education shall
138 contain the mark or logo of the National Association of State Boating
139 Law Administrators or other mark as approved by the Commissioner of
140 Energy and Environmental Protection to be deemed valid.
141 (2) No owner of a vessel shall knowingly authorize or permit a person
142 who is less than sixteen years of age who is required by this section to
143 obtain a safe boating certificate issued by the Commissioner of Energy
144 and Environmental Protection to operate such vessel on the waters of
145 the state without a safe boating certificate, unless such person is under
146 the direct onboard supervision of a person who is at least eighteen years
147 of age who has been issued a safe boating certificate and who has held
148 such certificate for at least two years.

149 (3) A safe boating certificate may be suspended or revoked, pursuant
150 to section 15-132a, 15-133, 15-140l or 15-140n, and shall be valid for the
151 life of the person to whom it is issued unless otherwise suspended or
152 revoked.
153 (4) The provisions of this section shall not apply to any person who,
154 between one hour before sunrise and one hour after sunset, operates a
155 vessel propelled exclusively by an electric motor that is rated at one
156 hundred six pounds of thrust or less on the inland waters of this state
157 upon which motor powered vessels exceeding ten horsepower are
158 prohibited.
159 (b) A safe boating certificate shall be issued under subsection (a) of
160 this section to any applicant regardless of age who provides proof that
161 such applicant has: (1) Successfully completed a course in safe boating
162 operation approved by the Commissioner of Energy and Environmental
163 Protection, which courses may include those offered by the United
164 States Power Squadrons, Coast Guard Auxiliary or other organizations,
165 or (2) successfully passed an equivalency examination testing
166 knowledge of safe boating operation administered by the commissioner.
167 (c) Notwithstanding subsection (a) of this section, any person who
168 purchases a new or used vessel may, upon vessel registration, apply to
169 the Department of Energy and Environmental Protection for a
170 temporary safe boating certificate which shall be valid for [three
171 months] forty-five days from the date of registration between sunrise
172 and sunset of each day. No person shall be issued more than one
173 temporary safe boating certificate.
174 (d) Any person operating a vessel other than a personal watercraft,
175 as defined in section 15-140j, as amended by this act, which is rented for
176 a period of [fourteen] seven days or less from a boat livery need not
177 obtain a certificate during the rental period, provided such person
178 operates the rented vessel only between sunrise and sunset of each day.
179 An owner, agent or employee of a boat livery shall furnish to each rental
180 customer literature on safety and rules of navigation as supplied by the

181 commissioner.
182 (e) Any person enrolled in a course in safe boating operation
183 approved by the Commissioner of Energy and Environmental
184 Protection may operate a vessel without a safe boating certificate when
185 under the direct onboard supervision of a boating instructor holding a
186 valid instructor number issued by the Department of Energy and
187 Environmental Protection.
188 (f) Notwithstanding the provisions of subsection (a) of this section,
189 on and after October 1, 2015, no person shall operate on the waters of
190 the state a vessel that is required to be registered or numbered pursuant
191 to this chapter and that is engaged in water skiing, as defined in section
192 15-127, unless such person: (1) Is not less than sixteen years of age, (2)
193 has a valid vessel operator license issued by the United States Coast
194 Guard, has obtained a safe boating certificate or certificate of personal
195 watercraft operation issued by the Commissioner of Energy and
196 Environmental Protection, [or] holds a boating safety certificate from a
197 state that has a reciprocal agreement with the commissioner pursuant to
198 section 15-140f or 15-140j, as amended by this act, or, on and after
199 January 1, 2022, meets the conditions applicable to other persons
200 contained in subsection (a) of this section, and (3) has a safe water skiing
201 endorsement on or accompanying such certificate that was issued by the
202 Commissioner of Energy and Environmental Protection upon such
203 person's completion of the safe water skiing instruction described in
204 section 15-140f. No owner of a vessel shall knowingly authorize or
205 permit a person who is less than sixteen years of age to operate such
206 vessel while engaged in water skiing on the waters of the state. The
207 requirements of subdivision (3) of this subsection shall not apply to any
208 resident or person who, on or before October 1, 2015, received a valid
209 vessel operator license issued by the United States Coast Guard,
210 obtained a safe boating certificate or certificate of personal watercraft
211 operation from the commissioner or held a boating safety certificate
212 from a state that has such a reciprocal agreement with the commissioner.
213 Nothing in this subsection shall be construed to prohibit the towing of
214 a person or a vessel during the course of an emergency that poses a

215 threat to human life or property.
216 (g) Any person who violates any provision of this section shall be
217 fined not less than sixty or more than two hundred fifty dollars for each
218 such violation.
219 (h) Any course in safe boating operation approved by the
220 Commissioner of Energy and Environmental Protection, as described in
221 subsection (b) of this section, shall include instruction on the proper
222 means of: (1) Inspecting a vessel and trailers used for transporting such
223 vessels for the presence of vegetation and aquatic invasive species, as
224 determined by the commissioner pursuant to subsection (a) of section
225 15-180; and (2) properly disposing of such vegetation and such aquatic
226 invasive species.
227 Sec. 7. Subsection (e) of section 15-140j of the general statutes is
228 repealed and the following is substituted in lieu thereof (Effective from
229 passage):
230 (e) Notwithstanding subsection (b) of this section, any person who
231 purchases a new or used personal watercraft may, upon vessel
232 registration, apply to the Commissioner of Energy and Environmental
233 Protection for a temporary certificate of personal watercraft operation
234 that shall be valid for [three months] forty-five days from the date of
235 registration, provided the applicant has successfully completed a course
236 in safe p
