SB1064 is a bill that amends current Arizona law regarding drug-free zones and the penalties for drug offenses within these zones. The bill introduces the concept of a "drug-free neighborhood zone," which includes areas within 300 feet of hospitals, nursing homes, drug treatment centers, mental and behavioral health facilities, and public parks. The bill makes it unlawful to knowingly sell or transfer fentanyl within these zones.

The bill also increases the penalties for drug offenses committed within these zones, adding one year to the presumptive, minimum, and maximum sentences. Additionally, it mandates a minimum fine of $2,000 or three times the value of the drugs involved, whichever is greater, and prohibits the suspension of any part of the fine. The bill requires the placement of visible signs to identify the boundaries of drug-free neighborhood zones and mandates that maps of these zones be prepared, filed with the county recorder, and provided to the county attorney. The bill modifies the culpable mental state from "intentionally" to "knowingly" for drug offenses in drug-free school zones and makes other technical and conforming changes.
