Overview

Repeals the Office of Administrative Hearings (OAH).

History

The OAH was established in 1995 to ensure that the public receives fair and independent administrative hearings (Laws 1995, Ch. 251   16). All state agencies supported by state General Fund sources, unless specifically exempted, and the Registrar of Contractors are required to use the services and personnel of the OAH to conduct administrative hearings relating to appealable agency actions and contested cases. Additionally, the OAH may provide administrative law judges on a contract basis to any governmental entity, including political subdivisions of the state.

The Director of OAH is appointed by the Governor and must have the experience necessary for appointment as an administrative law judge and possess supervisory, management and administrative skills. The Director is required to serve as the chief administrative law judge of the office, hire employees, make and execute contracts relating to OAH services and submit an annual report to the Governor and Legislature. Additionally, the OAH is required to employ full-time administrative law judges to conduct hearings (A.R.S.   41-1092.01).

The OAH is currently set to terminate on July 1, 2027 (A.R.S.   41-3027.03).
