FACT SHEET FOR H.J.R. 2001

Purpose

                      An emergency measure that consents to the sale of specified parcels of land in Pima County to the United States for and on behalf of the U.S. Department of Veterans Affairs (U.S. VA) for the purpose of use by the U.S. VA.

Background

                      Statute allows the state to consent to the acquisition of any privately owned real property within Arizona by the United States only upon the Governor's signing a joint resolution adopted by the Legislature to that effect. The joint resolution is required to recite the legal description of the land and the purposes to which the state consents that the property may be used (A.R.S.
  37-620.02
).

                      The U.S. Constitution grants the U.S. Congress the power to, for the erection of forts, magazines, arsenals, dock-yards and other needful buildings: 1) exercise exclusive legislation over such district (not exceeding 10 miles square) as may, by cession of particular states and the acceptance of Congress, become the seat of the U.S. government; and 2) exercise like authority over all places purchased by the consent of the Legislature of the state (U.S. Const. art. 1   8).

                      There is no anticipated fiscal impact to the state General Fund associated with this legislation.

Provisions

1.   Consents to the sale of specified parcels of land in Pima County to the United States for and on behalf of the U.S. VA for the purpose of use by the U.S. VA.

2.   Provides a legal description of the parcels of land being sold.

3.   Becomes effective on signature of the Governor, if the emergency clause is enacted.
