FACT SHEET FOR H.B. 2470

 

buffalo soldiers memorial; extension

Purpose

Extends, from October 1, 2021, to October 1, 2025, the date on which the authority of the Arizona Department of Administration (ADOA) to establish a memorial commemorating the Buffalo Soldiers in Wesley Bolin Plaza is repealed.

Background

A memorial may be placed in Wesley Bolin Plaza if a prior legislative act authorizes the memorial. Upon legislative authorization the proponents of the memorial must submit a concept to ADOA, which must review the concept and determine the most appropriate location. Before beginning construction of a memorial, the proponents must enter into a contract with ADOA specifying the conditions of final design, dimensions, location, artists, contractors and subcontractors. Any approved monument or memorial must be completed and dedicated within two years of the effective date of the authoring legislative act. Public monies may not be used for the costs of creating and developing a memorial. All fund-raising and contracts for artistic design and construction of the memorial are the sole responsibility of the memorial's proponents (A.R.S.   41-1363).

Laws 2018, Ch. 146 authorized ADOA to provide for the placement of a memorial dedicated to the commemoration of Buffalo Soldiers in Wesley Bolin plaza and included a repeal date of October 1, 2021.

There is no anticipated fiscal impact to the state General Fund associated with this legislation.

Provisions

1.   Extends, from October 1, 2021, to October 1, 2025, the date on which the authority of ADOA to establish a memorial commemorating the Buffalo Soldiers in Wesley Bolin Plaza is repealed.

2.   Becomes effective on the general effective date.
