Purpose
                      Removes the requirement that a pharmacist prescribe, administer and dispense oral fluoride varnish or tobacco cessation drug therapies according to Arizona Board of Pharmacy (Board) rules and modifies the definition of pharmacy.
Background
                      The
Board regulates the practice of pharmacy and the distribution, sale and storage
of prescription medications, prescriptive devices and nonprescription
medications in Arizona. The Board is charged with licensing pharmacists, pharmacy
interns, pharmacy technicians and pharmacy technician trainees in Arizona.
Statue requires the Board to adopt rules for the regulation of the pharmacy
profession including supplying drugs and devices. Currently, statute authorizes
the Board to adopt rules for prescribing and administering oral fluoride
varnish and rules for prescribing and dispensing tobacco cessation drug
therapies (A.R.S.     32-1902;
32-1903;
32-1904;
32-1979.02;
and 32-1979.03).
                      A pharmacy is any place: 1) where drugs, devices, poisons or related hazardous substances are offered for sale; 2) in which the profession of pharmacy is practiced or where prescriptions are stored and dispensed; 3) that is advertised with specified words or symbols; 4) that is leased, used or controlled by a Board licensee; or 5) that is considered a remote dispensing site, including a satellite pharmacy (A.R.S.   32-1901).
                      There is no anticipated fiscal impact to the state General Fund associated with this legislation.
Provisions
1.   Eliminates the requirement that a licensed and qualified pharmacist prescribe, administer and dispense oral fluoride varnish or tobacco cessation drug therapies according to Board rules.
2.   Modifies the definition of pharmacy to include any place where prescription orders are dispensed by a licensed pharmacist.
3.   Make technical and conforming changes.
4.   Becomes effective on the general effective date.
