occupational and professional licensure; notice.
Purpose
Requires a professional or occupational regulating entity to which reciprocity requirements apply to prominently print a prescribed notice relating to statutory reciprocity eligibility on all license and certificate applications and regulating entity websites.
Background
A professional or occupational regulating entity must grant a license or certificate to a person currently licensed or certified in another state who establishes residence in Arizona and applies for a license or certificate in the same discipline and practice level. Reciprocity requirements do not apply to: 1) a license or registration relating to private investigators and security guards; or 2) a license, permit or certificate of eligibility under an interstate compact.
To be eligible for professional or occupational reciprocity, a person must: 1) have been licensed or certified by another state for at least one year; 2) meet the applicable education, work experience, clinical supervision and exam requirements of the state in which they are licensed or certified; 3) be in good standing and not had the license or certificate revoked or voluntarily suspended; 4) not have any complaints, allegations, or pending investigations or have any discipline relating to unprofessional conduct by another regulating entity; 5) pay all applicable fees; and 6) not have a disqualifying criminal history. A regulating entity may require an applicant to take and pass an examination on the laws of Arizona. Once the license or certificate is issued, the person is subject to Arizona law regulating the person's practice and the regulating entity's jurisdiction (A.R.S. 32-4302).
There is no anticipated fiscal impact to the state General Fund associated with this legislation.
Provisions
1. Requires a professional or occupational regulating entity to which reciprocity requirements apply to prominently print on all license and certificate applications and regulating entity websites the following notice:
"Pursuant to section 32-4302, Arizona Revised Statutes, a person shall be granted an occupational or professional license or certificate if the person has been licensed or certified in another state for at least twelve months, the license or certificate is in the same discipline and at the same practice level as the license or certificate for which the person is applying in this state and the person meets other conditions prescribed by section 32-4302, Arizona Revised Statutes."
2. Makes technical changes.
3. Becomes effective on the general effective date.
