missing and murdered indigenous peoples

Purpose

                      Renames the Study Committee on Missing and Murdered Indigenous Women and Girls as the Study Committee on Missing and Murdered Indigenous Peoples (MMIP). Modifies the MMIP membership and duties.

Background

                      The Study Committee on Missing and Murdered Indigenous Women and Girls was established in 2019 to conduct a study on how to reduce and end violence against indigenous women and girls in Arizona (Laws 2019, Ch. 232).

                      The Consumer Protection-Consumer Fraud Revolving Fund (Fund) is administered by the Attorney General and consists of monies recovered for the state from investigative or court costs, attorney fees and civil penalties relating to consumer protection or fraud. The Fund has an estimated FY 2021 ending balance of $36,981,200 (JLBC Baseline).

                      There is no anticipated fiscal impact to the state General Fund associated with this legislation.

Provisions

1.   Renames the Study Committee on Missing and Murdered Indigenous Women and Girls as the MMIP.

2.   Modifies membership of the MMIP by:

a)   adding one attorney general or judge from a tribal jurisdiction appointed by the Senate President;

b)   reducing, from three to four, the number of members from the House of Representatives and Senate who are of indigenous descent;

c)   removing the peace officer member who resides on a federally recognized American Indian Reservation in Arizona appointed by the Speaker of the House of Representatives;

d)   removing the representative from the Southwest Indigenous Women's Coalition appointed by the Speaker of the House of Representatives;

e)   removing the county attorney and sheriff from a county with a population of less than 850,000 persons appointed by the President of Senate;

f) removing the chief of police of a tribal police department appointed by the President of the Senate; and

g)   removing a representative who works with a tribal, statewide or local organization that provides legal services to indigenous women and girls appointed by the President of the Senate.

3.   Includes, in the duties of the MMIP, gathering data on the prevalence and contextual characteristics of violence against indigenous peoples and gathering information to understand the experiences among indigenous peoples surrounding missing and murdered indigenous peoples.

4.   Requires the MMIP, on or before December 1 in calendar years 2022, 2023 and 2024, to submit a report on the MMIP's activities and recommendations to the Governor and Legislature and provide a copy to the Secretary of State.

5.   Continues the MMIP until September 30, 2025.

6.   Appropriates $40,000 from the Fund in FY 2022 to the Attorney General for the MMIP and exempts the appropriation from lapsing.

7.   Becomes effective on the general effective date.
