FACT SHEET FOR H.B. 2075

 

sentencing; judgment of guilt; fingerprints

Purpose

                      Removes the requirement that the court must affix or record the defendant's fingerprint or fingerprints following a judgment of guilt at the time of sentencing and in open court.

Background

                      Statute requires the court or a person appointed by the court, at the time of sentencing and in open court, to either: 1) permanently affix a defendant's fingerprint to a judgment of guilt and sentence document or minute order; or 2) obtain and record the defendant's two fingerprint biometric-based identifier in the court case file (A.R.S.   13-607).

                                                    There is no anticipated fiscal impact to the state General Fund associated with this legislation.

Provisions

1.   Allows the court to collect the defendant's fingerprint or two fingerprint biometric-based identifier:

a)   at a time other than the time of sentencing; and

b)   at a place other than open court.

2.   Makes technical changes.

3.   Becomes effective on the general effective date.
