22 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

24 SECTION 1. Arkansas Code § 12-27-114(a), as amended by Acts 2023, No.
25 133, § 1, and concerning the reimbursement of counties for housing inmates in
26 county jails, is amended to read as follows:
27 (a)(1)(A)(i) In the event the Division of Correction cannot accept
28 inmates from county jails due to insufficient bed space, the Division of
29 Correction shall reimburse the counties from the County Jail Reimbursement
30 Fund at rates determined by the Chief Fiscal Officer of the State, after
31 consultation with Arkansas Legislative Audit and the Division of Correction
32 and upon approval by the Governor, until the appropriation and funding
33 provided for that purpose are exhausted for the actual cost of housing the
34 inmate in the county jail.
35 (ii) The reimbursement rate amount shall include the
36 county's cost of transporting the inmates to the Division of Correction.

1 (B)(i) Reimbursement under subdivision (a)(1)(A) of this
2 section shall begin accruing on the date of sentencing.
3 (ii) The Division of Correction shall not reimburse
4 the county until the Division of Correction receives a complete and accurate
5 sentencing order.
6 (2)(A) In the event the Division of Community Correction cannot
7 accept inmates from county jails due to insufficient bed space or shall have
8 an inmate confined in a county jail under any prerelease program or sanction
9 imposed in response to a violation of supervision conditions, the Division of
10 Community Correction shall reimburse the counties from the fund at rates
11 determined by the Chief Fiscal Officer of the State, after consultation with
12 Arkansas Legislative Audit and the Division of Correction, and upon approval
13 by the Governor, until the appropriation and funding provided for that
14 purpose are exhausted for the actual cost of housing the inmate in the county
15 jail.
16 (B)(i) Reimbursement under subdivision (a)(2)(A) of this
17 section shall begin accruing on either the date of sentencing or the date of
18 placement on probation accompanied with incarceration in the Division of
19 Community Correction.
20 (ii) The Division of Community Correction shall not
21 reimburse the county until the Division of Community Correction receives a
22 complete and accurate sentencing order or an order or waiver for a sanction
23 to a community correction center.
