14 WAIVER BASED ON ANNUAL ASSISTED LIVING COST REPORTS;

24 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

26 SECTION 1. Arkansas Code Title 20, Chapter 10, Subchapter 1, is
27 amended to add an additional section to read as follows:
28 20-10-113. Fair Reimbursement and Assisted Living Cost Reporting Act
29 of 2023.
30 (a) This section shall be known and may be cited as the "Fair
31 Reimbursement and Assisted Living Cost Reporting Act of 2023".
32 (b) The Department of Human Services shall annually report to:
33 (1) The House Committee on Public Health, Welfare, and Labor;
34 (2) The Senate Committee on Public Health, Welfare, and Labor;
35 and
36 (3) Legislative Council.

1 (c) The report described in subsection (b) of this section shall
2 include without limitation:
3 (1) Aggregate cost report data supplied to the department by
4 assisted living providers;
5 (2) The number of beds available for Medicaid beneficiaries and
6 private pay by county;
7 (3) Total number of beds available in the state for the most
8 vulnerable, qualifying individuals;
9 (4) The cost per bed to the state;
10 (5) Rural costs compared to urban costs; and
11 (6) Access data, including a three-year trend of access
12 availability by county or region.
13 (d)(1) The department shall consider the data within the report and
14 the cost report data when making any amendment, alteration, rule change, and
15 equitable reimbursement rate affecting the Living Choices waiver.
16 (2) The department shall report differences in the cost study
17 and waiver reimbursement rate and potential causes of the differences.
