Bill Subtitle: TO AMEND THE LAW CONCERNING THE ISSUANCE OF A DRIVER'S LICENSE TO
A MILITARY LICENSEE.

Basic Change :
Sponsors: Sens. M. Johnson and J. Boyd and Rep. Achor
SB438 permits active duty military personnel and their dependents to obtain an Arkansas driver's
license when their license has expired for more than 31 days.
Under current law, the spouse of a member of the military who was living outside of the United States
due to a military duty assignment may obtain an Arkansas driver's license even though their
out-of-state license has expired for more than 31 days. SB434 expands the list of individuals who may
obtain an Arkansas driver's license when their out-of-state or military license has expired for more than
31 days to include:
 An active duty military member; and
 The dependent of an active duty military member.
The applicant must surrender their expired driver's license, present a copy of their unexpired military
identification, and pay all applicable fees.
Revenue Impact :
None
Taxpayer Impact :
An active duty military member or his or her dependents may present a driver's license issued to the
person by another state or by a branch of the United States Armed Forces that expired more than 31
days prior to the date presented to receive an Arkansas driver's license without having to retest all
phases of the driver's license exam.
Resources Required :
The Arkansas Integrated Revenue System (AIRS) will need to be modified. A project cost of $6,000
with an ongoing yearly maintenance cost of $1,000.
Time Required :
Adequate time has been provided for implementation.
Procedural Changes :
The Office of Driver Services would have to update the issuance process for an active duty military
member, the spouse of an active duty military member, or the dependent of an active duty military
member that presents an expired driver's license. Training materials would need to be created for
Driver Services, State Revenue Offices, and Arkansas State Police examiners.
