20 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

22 SECTION 1. Arkansas Code 10-2-111 is amended to read as follows to
23 correct the classification of a criminal offense pursuant to 5-1-107(a)(2)
24 and 5-1-108(b) and to correct word usage:
25 10-2-111. Unauthorized use of roll call system Penalty.
26 (a) Any person who, by tampering with the mechanism of the electric
27 roll call system in the Chamber of the House of Representatives, shall
28 willfully cause causes the vote indicated at any station to be incorrectly
29 recorded shall be is guilty of a misdemeanor, violation and, upon conviction,
30 he or she shall be fined not less than one hundred dollars ($100) nor more
31 than five thousand dollars ($5,000).
32 (b) Any person not a member of the House of Representatives who,
33 during the taking of a vote on any matter before a session of the House or
34 during the calling of a roll in the House, shall operate operates a voting
35 station of the electric roll call system shall be is guilty of a misdemeanor
36 violation and, upon conviction, he or she shall be fined not less than one

3 SECTION 2. Arkansas Code 10-4-429(e), concerning reports of security
4 incidents that are exempt security functions under the Freedom of Information
5 Act of 1967, is amended to read as follows to clarify a reference:
6 (e) A report, update, notification, or list created or maintained
7 under this section is exempt from disclosure under the Freedom of Information
8 Act of 1967, 25-19-101 et seq., as a security function under 25-19-
9 105(b)(11).

11 SECTION 3. DO NOT CODIFY. CONSTRUCTION AND LEGISLATIVE INTENT.
12 It is the intent of the General Assembly that:
13 (1) The enactment and adoption of this act shall not expressly
14 or impliedly repeal an act passed during the regular session of the Ninety-
15 Fourth General Assembly;
16 (2) To the extent that a conflict exists between an act of the
17 regular session of the Ninety-Fourth General Assembly and this act:
18 (A) The act of the regular session of the Ninety-Fourth
19 General Assembly shall be treated as a subsequent act passed by the General
20 Assembly for the purposes of:
21 (i) Giving the act of the regular session of the
22 Ninety-Fourth General Assembly its full force and effect; and
23 (ii) Amending or repealing the appropriate parts of
24 the Arkansas Code of 1987; and
25 (B) Section 1-2-107 shall not apply; and
26 (3) This act shall make only technical, not substantive, changes
27 to the Arkansas Code of 1987.
