Basic Change :

Senate Amendment No. 1 --- HB1208-S1 (engrossed S2/16/23) removes the requirement that a
probationer or parolee hold a suspended driver's license to be eligible for a restricted driving permit.
Instead, to be eligible for a restricted driving permit, a probationer or parolee must be qualified to
operate a motor vehicle under Arkansas law. HB1208-S1 also clarifies that the restricted driving permit
issued is valid for one year from the date the permit is issued and may be renewed annually upon
application by a parole or probation officer.
Under current law, the Department of Finance and Administration (DFA) is authorized to revoke a
restricted driving permit at any time and for any reason. HB1208-S1 allows a revocation of the permit
upon the request of a probation or parole officer.
Original Bill --- HB1208 amends the expiration date of the restricted driving permit of a probationer or
parolee under ยง 27-16-816. An individual who is on probation or parole, or within 90 days of release,
for an offense that did not involve the operation of a motor vehicle, may be eligible for a restricted
driving permit that permits the individual to drive to and from work, their child's school, or meetings with
their probation or parole officer.
Under current law, the restricted driving permit expires on the date the probationer or parolee is
released from probation or parole. HB1208 amends the expiration date of the restricted driving permit
to one year from the date the permit was issued. The bill also requires that a probationer or parolee
hold a suspended driver's license to be eligible for a restricted driving permit.
Revenue Impact :
None.
Taxpayer Impact :
A restricted driving permit issued to a parolee or probationer would be valid for one year and could be
renewed annually upon application by a probation or parole officer. DFA may revoke a restricted permit
at the request of the Division of Community Correction.
Resources Required :
The Arkansas Integrated Revenue System (AIRS) will need to be modified. The estimated cost for
programming changes is $24,000 and a yearly maintenance cost of $1,000.
Time Required :
Adequate time is provided for implementation.
