9 AN ACT TO AMEND THE LAW REGARDING THE RETIREMENT OF
10 MAYORS OF CITIES OF THE FIRST CLASS; TO CLARIFY THAT
11 A MAYOR OF A CITY OF THE FIRST CLASS IS ENTITLED TO
12 APPLY PREVIOUS OR SUBSEQUENT YEARS OF SERVICE IN
13 EMPLOYMENT WITH THE SAME CITY TOWARD THE MAYOR'S
14 RETIREMENT; AND FOR OTHER PURPOSES.

18 TO CLARIFY THAT A MAYOR OF A CITY OF THE
19 FIRST CLASS IS ENTITLED TO COUNT PREVIOUS
20 OR SUBSEQUENT YEARS OF SERVICE IN
21 EMPLOYMENT WITH THE SAME CITY TOWARD THE
22 MAYOR'S RETIREMENT.

25 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

27 SECTION 1. Arkansas Code § 24-12-123(a)(3), concerning the retirement
28 of mayors of cities of the first class, is amended to read as follows:
29 (3) However, a mayor who has served as an elected official or
30 employee of that city prior to or after the person's service as mayor shall
31 count his or her service as an elected official or employee of that city
32 towards the mayor's retirement as follows:
33 (A)(i) At the rate of one (1) year of a mayor's retirement
34 for each two (2) years served as an elected official or an employee of that
35 city up to a maximum of an additional two (2) years' credit towards a mayor's
36 retirement benefit;

1 (ii)(B) If authorized by a city ordinance, at the rate of
2 one (1) year of a mayor's retirement benefit for each two (2) years served as
3 an elected official or an employee of that city up to a maximum of three (3)
4 additional years' credit towards a mayor's retirement benefit if the person
5 has not fewer than twenty (20) years of mayor's credit and is at least fifty-
6 two (52) years of age; or
7 (iii)(C) If authorized by a city ordinance, at the rate of
8 one (1) year of a mayor's retirement benefit for each two (2) years served as
9 an elected official or an employee of that city up to a maximum of four (4)
10 additional years' credit towards a mayor's retirement benefit if the person
11 has not fewer than twenty (20) years of mayor's credit and is at least fifty-
12 four (54) years of age; and
13 (B) Service as an elected official or as an employee of the city
14 that is also covered under another retirement plan offered by the city or
15 that is covered by another benefit provided for by law shall not be applied
16 towards the mayor's retirement benefits provided for under this section.

18 SECTION 2. Arkansas Code § 24-12-123, concerning the retirement of
19 mayors of cities of the first class, is amended to add an additional
20 subsection to read as follows:
21 (e) Under § 14-42-117, a mayor who receives a retirement benefit
22 from a city under this section shall not be entitled to any retirement
23 benefit based upon service for the same period from any other state
24 authorized plan.
