28 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

30 SECTION 1. DO NOT CODIFY. This act shall be known and may be cited as
31 the "Raising Arkansas's Investment in Schools and Educators (RAISE) Act".
32
33 SECTION 2. APPROPRIATION - TEACHER PAY SUSTAINABILITY PROGRAM. There
34 is hereby appropriated, to the Department of Education - Division of
35 Elementary and Secondary Education, to be payable from the Division of
36 Elementary and Secondary Education Public School Fund Account for the Teacher

1 Pay Sustainability Program for providing additional funding to public school
2 districts in order to provide an immediate raise for teachers as defined by
3 Arkansas Code 6-17-2402 and to assist public school districts in meeting
4 the minimum salary schedule established by Arkansas Code 6-17-2403 and
5 amended by this act for teachers as defined by Arkansas Code 6-17-2402 by
6 the Department of Education - Division of Elementary and Secondary Education
7 for the fiscal year ending June 30, 2023, the following:

13 SECTION 3. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS
14 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. FUNDING
15 TRANSFER. Immediately upon the effective date of this act the Chief Fiscal
16 Officer of the State shall transfer on his or her books and those of the
17 State Treasurer and the Auditor of State, a sum of six hundred million
18 dollars ($600,000,000) from the General Revenue Allotment Reserve Fund to a
19 new Teacher Pay Sustainability sub-fund in the Educational Adequacy Fund,
20 there to be used specifically for the purpose of distributing grants and aid
21 to local public school districts by the Department of Education for the
22 Teacher Pay Sustainability Program.

24 SECTION 4. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS
25 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. TEACHER
26 PAY SUSTAINABILITY PROGRAM. Upon the effective date of this act, and as
27 needed from time to time thereafter as determined by the Department of
28 Education, the Arkansas State Treasurer shall transfer funds from the
29 Educational Adequacy Fund - Teacher Pay Sustainability sub-fund to the
30 Division of Elementary and Secondary Education Public School Fund Account to
31 be used solely for the implementation of the Teacher Pay Sustainability
32 Program. Funds in the Teacher Pay Sustainability sub-fund shall be kept
33 separate from all other monies in the Educational Adequacy Fund and shall be
34 utilized by the Department of Education to provide grants and aid to assist
35 public school districts in ensuring that all teachers as defined by Arkansas
36 Code 6-17-2402 receive an immediate $4,000 raise in pay and that those

1 teachers as defined by Arkansas Code 6-17-2402 receive at least a minimum
2 annual salary of $42,000 as established by Arkansas Code 6-17-2403 and
3 amended in this act. The Teacher Pay Sustainability sub-fund shall not be
4 considered part of a public school district's net legal balance or net legal
5 balance revenues as those terms are defined in Arkansas Code 6-20-2210 for
6 the purpose of meeting the requirements on limitation of fund balances
7 pursuant to Arkansas Code 6-20-2210. The Arkansas Department of Education
8 shall promulgate rules to administer this section.

10 SECTION 5. SPECIAL LANGUAGE. CODE AMENDMENT. Arkansas Code 6-17-
11 2402(3), concerning the definition of "teacher" under the Teacher
12 Compensation Program of 2003, is amended to read as follows:
13 (3) Teacher means:
14 (A) An individual who is required to hold a teaching
15 license from the Division of Elementary and Secondary Education and who is
16 engaged directly in instruction with students in a classroom setting for more
17 than seventy percent (70%) of the individual's contracted time;
18 (B) A guidance counselor; or
19 (C) A librarian;
20 (D) A curriculum specialist;
21 (E) An instructional facilitator; or
22 (F) Any other full-time employee of a public school
23 district who is not in an administrator or director-level
24 role and who is required to hold a teaching license issued
25 by the State Board of Education as a condition of
26 employment.

28 SECTION 6. SPECIAL LANGUAGE. CODE AMENDMENT. Arkansas Code 6-17-
29 2403(b), concerning the minimum teacher compensation schedule, is amended to
30 read as follows:

33 SECTION 7. COMPLIANCE WITH OTHER LAWS. Disbursement of funds
34 authorized by this act shall be limited to the appropriation for such agency
35 and funds made available by law for the support of such appropriations; and
36 the restrictions of the State Procurement Law, the General Accounting and

1 Budgetary Procedures Law, the Revenue Stabilization Law, the Regular Salary
2 Procedures and Restrictions Act, or their successors, and other fiscal
3 control laws of this State, where applicable, and regulations promulgated by
4 the Department of Finance and Administration, as authorized by law, shall be
5 strictly complied with in disbursement of said funds.

7 SECTION 8. LEGISLATIVE INTENT. It is the intent of the General
8 Assembly that any funds disbursed under the authority of the appropriations
9 contained in this act shall be in compliance with the stated reasons for
10 which this act was adopted, as evidenced by the Agency Requests, Executive
11 Recommendations and Legislative Recommendations contained in the budget
12 manuals prepared by the Department of Finance and Administration, letters, or
13 summarized oral testimony in the official minutes of the Arkansas Legislative
14 Council or Joint Budget Committee which relate to its passage and adoption.

16 SECTION 9. EMERGENCY CLAUSE. It is found and determined by the General
17 Assembly of the State of Arkansas that the retention of teachers and
18 providing appropriate compensation to them is of the utmost importance to the
19 public peace, health, and safety of the state of Arkansas; that the funds
20 designated to assist public school districts in retaining teachers as defined
21 by Arkansas Code 6-17-2402 should be made available immediately; and that
22 this act is immediately necessary to provide a funding mechanism to provide
23 immediate assistance to public school districts in meeting the minimum salary
24 schedule established by Arkansas Code 6-17-2403 and amended by this act and
25 providing immediate raises to teachers as defined by Arkansas Code 6-17-
26 2402 in public school districts. Therefore, an emergency is declared to
27 exist, and this act being immediately necessary for the preservation of the
28 public peace, health, and safety shall become effective on:
29 (1) The date of its approval by the Governor;
30 (2) If this bill is neither approved nor vetoed by the Governor, the
31 expiration of the period of time during which the Governor may veto the bill;
32 or
33 (3) If the bill is vetoed by the Governor and the veto is overridden,
34 the date the last house overrides the veto.
