22 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

24 SECTION 1. APPROPRIATION - EXTRA HELP - CASH. There is hereby
25 appropriated, to the Auditor of State-Deputy Prosecuting Attorneys, to be
26 payable from the cash fund deposited in the State Treasury as determined by
27 the Chief Fiscal Officer of the State, for extra help and associated matching
28 costs for the fiscal year ending June 30, 2022, the following:

35 SECTION 2. APPROPRIATION - EXTRA HELP - FEDERAL FUNDS. There is
36 hereby appropriated, to the Auditor of State-Deputy Prosecuting Attorneys, to

1 be payable from the federal funds as designated by the Chief Fiscal Officer
2 of the State, for extra help and associated matching costs for the fiscal
3 year ending June 30, 2022, the following:

8 (01) EXTRA HELP AND ASSOCIATED MATCHING COSTS $4,500,000

10 SECTION 3. EXTRA HELP. There is hereby authorized, for the Auditor of
11 State - Deputy Prosecuting Attorneys for the 2021-2022 fiscal year, the
12 following maximum number of part-time or temporary employees, to be known as
13 "Extra Help", payable from funds appropriated herein for such purposes:
14 forty-five (45) temporary or part-time employees, when needed, at rates of
15 pay not to exceed those provided in the Uniform Classification and
16 Compensation Act, or its successor, or this act for the appropriate
17 classification.

19 SECTION 4. COMPLIANCE WITH OTHER LAWS. Disbursement of funds
20 authorized by this act shall be limited to the appropriation for such agency
21 and funds made available by law for the support of such appropriations; and
22 the restrictions of the State Procurement Law, the General Accounting and
23 Budgetary Procedures Law, the Revenue Stabilization Law, the Regular Salary
24 Procedures and Restrictions Act, or their successors, and other fiscal
25 control laws of this State, where applicable, and regulations promulgated by
26 the Department of Finance and Administration, as authorized by law, shall be
27 strictly complied with in disbursement of said funds.

29 SECTION 5. LEGISLATIVE INTENT. It is the intent of the General
30 Assembly that any funds disbursed under the authority of the appropriations
31 contained in this act shall be in compliance with the stated reasons for
32 which this act was adopted, as evidenced by the Agency Requests, Executive
33 Recommendations and Legislative Recommendations contained in the budget
34 manuals prepared by the Department of Finance and Administration, letters, or
35 summarized oral testimony in the official minutes of the Arkansas Legislative
36 Council or Joint Budget Committee which relate to its passage and adoption.

2 SECTION 6. EMERGENCY CLAUSE. It is found and determined by the General
3 Assembly of the State of Arkansas that coronavirus 2019 (COVID-19) created a
4 backlog in the criminal justice system and has put undue stress on the
5 state's prosecutors. There is a need to hire deputy prosecuting attorneys in
6 an extra help capacity in order to help reduce the backlog in criminal cases
7 that currently exists throughout the state. Therefore, an emergency is
8 declared to exist, and this act being immediately necessary for the
9 preservation of the public peace, health, and safety shall become effective
10 on:
11 (1) The date of its approval by the Governor;
12 (2) If the bill is neither approved nor vetoed by the Governor,
13 the expiration of the period of time during which the Governor may veto the
14 bill; or
15 (3) If the bill is vetoed by the Governor and the veto is
16 overridden, the date the last house overrides the veto.
