11 TO THOSE FUNDS APPROPRIATED BY ACT 843 OF 2021; AND
12 FOR OTHER PURPOSES.

21 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:
22
23 SECTION 1. APPROPRIATION - GRANTS. There is hereby appropriated, to
24 the Department of Human Services, to be payable from the paying account as
25 determined by the Chief Fiscal Officer of the State, for grant payments of
26 the Department of Human Services - Division of Medical Services which shall
27 be supplemental and in addition to those funds appropriated in Section 4 of
28 Act 843 of 2021, the following:

34 SECTION 2. COMPLIANCE WITH OTHER LAWS. Disbursement of funds
35 authorized by this act shall be limited to the appropriation for such agency
36 and funds made available by law for the support of such appropriations; and

1 the restrictions of the State Procurement Law, the General Accounting and
2 Budgetary Procedures Law, the Revenue Stabilization Law, the Regular Salary
3 Procedures and Restrictions Act, or their successors, and other fiscal
4 control laws of this State, where applicable, and regulations promulgated by
5 the Department of Finance and Administration, as authorized by law, shall be
6 strictly complied with in disbursement of said funds.

8 SECTION 3. LEGISLATIVE INTENT. It is the intent of the General
9 Assembly that any funds disbursed under the authority of the appropriations
10 contained in this act shall be in compliance with the stated reasons for
11 which this act was adopted, as evidenced by the Agency Requests, Executive
12 Recommendations and Legislative Recommendations contained in the budget
13 manuals prepared by the Department of Finance and Administration, letters, or
14 summarized oral testimony in the official minutes of the Arkansas Legislative
15 Council or Joint Budget Committee which relate to its passage and adoption.

17 SECTION 4. EMERGENCY CLAUSE. It is found and determined by the General
18 Assembly, that funds provided by the General Assembly for the operations of
19 the Department of Human Services - Division of Medical Services are, due to
20 unforeseen circumstances, insufficient for the Department of Human Services -
21 Division of Medical Services to continue to provide essential governmental
22 services; that the provisions of this act will provide the necessary monies
23 for the Department of Human Services - Division of Medical Services to
24 continue such services; and that a delay in the effective date of this Act
25 could work irreparable harm upon the proper administration and provision of
26 essential governmental programs. Therefore, an emergency is hereby declared
27 to exist and this Act being necessary for the immediate preservation of the
28 public peace, health and safety shall be in full force and effect from and
29 after the date of its passage and approval.
30 If the bill is neither approved nor vetoed by the Governor, it shall
31 become effective on the expiration of the period of time during which the
32 Governor may veto the bill. If the bill is vetoed by the Governor and the
33 veto is overridden, it shall become effective on the date the last house
34 overrides the veto.
